Don Pickett:
Present: Frank Velasqez: Present.

Ross:

Has the staff Certified the proper Public Notice as to the
rescheduled hearing? The
notices were mailed for this meeting and for the original
meeting September 13, 1979.

Eugene A. DiCarlo, 104 Aline Street, Block 15, Lot 4, Bella
Vista Subdivision requests relief from a rear yard set back
from 25 feet to 20 feet to allow for construction of a
garage. Will the applicant please present his presentation?

Ross:

DiCarlo:

My name is Eugene A. DiCarlo, I reside at 104 Aline Street.
First of all I want to apologize to the Board of Appeals
and Zoning Adjustment for my absense last week. live been
geared so long to 7:30 meetings that I apologize for being
late and also for the incovenience of the- Board to meet
this evening. live asked for a variance of 5 feet when
actually I only really need 3. I believe that if the
variance were for 25 to 22 feet lid still be in compliance,
if I was granted the variance. This was pointed out to
me by Mr. Ferris and I think that I can comply with that.
Itls an addition of a garage that is causing this variance,
thatls why I'm asking for the Board of Adjustment to grant
a variance if possible.

Ross:

Section 17.12.040 of the Louisville Municipal Code requires
a 25 foot rear yard set back. There are no people from
a 300 foot radius in favor of the variance, so weill move
on to statements by any persons opposed, or comments by
s ta f f .
