<br />BOARD OF APPEALS AND BOARD OF ADJUSTMENT MINUTES: ORGANIZATIONAL MEETING <br />JANUARY 24, 1980 PAGE 4 <br /> <br />Don Ross says that the Chairman would have to explain to the applicant that if <br />there were only 4 members present, that it would have to take all 4 votes to <br />approve it. <br /> <br />Pickett comments that it takes'~the motion 'to either 'deny or approve, and that <br />the motion should be to approve it. <br /> <br />Ferris confirms that that's the way it's spelled out. <br /> <br />Pickett says that it has to be a motion to approve it, you can't make a motion <br />to deny it. <br /> <br />Chairman then comments that because of the vote it's automatically denied. <br /> <br />Pickett confirms this as well as Ferris does again. <br /> <br />Chairman states that going on approval, if it doesn't go by the Quorum, those <br />4 concurring votes, it's automatically denied. <br /> <br />Rupp says that as long as it's clear in their minds how it operates, and if <br />their motions are to approve, held say they were okay. <br /> <br />2. Section 7. Setting of the Hearing Dates. <br /> <br />In this Section, Chairman asks for some discussion on the portion, liThe date for <br />the Public Hearing shall be set within 5 days of the receipt of an application <br />for a variance and paymanet of the required filing fee. Said fee shall be one <br />ha 1 f the Zoni ng Amendment Fee . II He then asks if the fee was $50.00 at <br />one time. <br /> <br />Ferris replies that it still is. <br /> <br />Chairman then asks if it was $30.00 at one time. <br /> <br />Ferris replies that it was $20.00 <br /> <br />Chairman then remembers that it was $20.00 when they first started, then it <br />went up to $30.00 to $50.00. He then asks if anything else has gone up or if <br />Ferris just wanted to leave it at $50.00. <br /> <br />Ferris replied that he would have to find out what the Zoning Amendment fee was, <br />if it had been raised, and if he would have to raise it. He said that the $50.00 <br />was covering the cost of mailing out and everything else, do he didn't see a <br />problem. <br /> <br />-. <br />Davies asked what the Zoning Amendment fee was of right now. <br /> <br />Rupp replied that it was $100.00 <br />Chairman confirmed that the cost should then be $50.00. <br />
