BOARD OF APPEALS AND BOARD OF ADJUSTMENT MINUTES: ORGANIZATIONAL MEETING
JANUARY 24, 1980 PAGE 7

Rupp suggests that maybe the State means that 5 people will have to sit at the
Board to make the decision, not that it necessarily means you can't have any
alternates.

Ferris points out that one of the Counsel, Curt Rautenstrauss, said that that
was kind of a fine line. He said that if 2 of the 7 members don't re-app1y
for a place on the Board, just leave it alone. Ferris said he would talk
with Curt Rauntenstrauss the next day and try to get something squared away.

Ewan and Davies suppose that it may be a situation whereas the 5 regular members
and the 2 alternates cannot both sit in on a variance. Only 5 can sit in,
and only 5 have the power to vote, and 2 of those mayor may not be an
alternate, such as the alternate members of a jury. The alternate member would
not have the voting power until the time it was needed.

Reed quotes that "In the event that any regular member is temporarily unable to
act owing to absense from the City, illness, interest in the case before the
Board, or any other cause, his place may be taken during such temporary dis-
ability by an associate member who shall enjoy full privileges".

Ferris says that he will see Counsel and try to get it squared away with them.

6. CLOSE OF THE MEETING

A. Closing Comments.

Chairman puts the question to the Board if they've been getting their
variance notifications and everything else.

Don Ross replies that hels getting his notifications in the mail.
Rupp then thanks everyone for the oppurtunity to sit it on the meeting.
B. Adjournment of the Meeting.

Chairman adjourns the meeting.
