<br />Louisville City Council Meeting <br />November 4,2003 <br />Page 5 of 11 <br /> <br />APPROVAL OF PROFESSIONAL SERVICES AGREEMENT <br /> <br />Mayor Davidson called for Staff presentation. <br /> <br />Public Works Director Tom Phare reported the Public Works Department is requesting <br />approval of amendments to the June 17, 2003 professional contract agreement by and <br />between the City of Louisville and Rothberg, Tamburini & Winsor, Inc. (RTW), for <br />engineering services related to the construction of the reclaimed water treatment facility <br />at the Wastewater Treatment Plant and pipeline installation to the golf course. He <br />explained R TW has completed the design phase for the reclaimed water system and is <br />ready to participate in construction phase of the project. The second amendment contract <br />document includes detailed scope of services and related expenses. He referenced exhibit <br />"A", which includes detailed scope of services completed including pre-bid construction <br />meeting and railroad permit fees. Staff recommends Council approval of a contract <br />amendment with RTW, Inc. for professional engineering services related to construction <br />management services for reclaimed water treatment facility and pipeline and additional <br />design services in the amount not to exceed $109,200. <br /> <br />COUNCIL COMMENT <br /> <br />f- <br />w <br />~ <br />\J <br />~ <br />a.. <br /> <br />MOTION: Council member Keany moved that Council approve the amendments to the <br />June 17, 2003 professional contract agreement and between the City of Louisville and <br />Rothberg, Tamburini & Winsor, Inc., for professional engineering services in an amount <br />not to exceed $109,200, seconded by Mayor Pro Tern Sisko Roll call vote was taken. <br />The motion carried by a vote of7-0. <br /> <br />HIGHWAY 42/96111 STREET CONNECTION BID AWARD <br />RECOMMENDATION <br /> <br />Mayor Davidson called for Staff presentation. <br /> <br />Public Works Director Tom Phare reported on the October 14,2003 bid opening for the <br />State Highway 42/96th Street Connection Project. All bidders were pre-qualified for the <br />project. The low bidder on the Project, Lawrence Construction Company, bid a total bid <br />price of$7,171,066.38, however during the bid analysis errors were discovered, which <br />resulted in incorrect unit an total prices resulting in inconsistencies with engineer's <br />estimates and industry norms. He explained the bid documents permit the City to waive <br />minor informalities and to reject any and all bids. One stated reason for waiving <br />informalities provides that unit price bids, which include reconcilable arithmetic errors <br /> <br />may be corrected, so long as it does not change the amount on which the award will be <br />based. Lawrence explained in their October 17 letter, the errors in the bid and confirmed <br />its bid would remain at $7,171,055.38, which is $94,555.02 less than the next bid. Phare <br />stated Council has the option to award the bid to Lawrence Construction Company and <br />waive the informalities in its bid.
