Mayer stated that he also <br />attended the grand opening of Sam's Club and expressed concern for the number of trees <br />that appear to be in poor condition and need of replacement. <br /> <br />Davidson suggested contacting Senator Nighthorse Campbell for his assistance regarding <br />the Post Office. <br /> <br />REGULAR BUSINESS <br /> <br />ORDINANCE NO. 1292, SERIES 1999 - AN ORDINANCE ESTABLISHING A <br />TEMPORARY MORATORIUM ON THE SUBMITTAL AND PROCESSING OF <br />COMMERCIAL PUD APPLICATIONS IN DOWNTOWN LOUISVILLE - <br />PUBLIC HEARING (advertised Louisville Times, 1/27/99; Daily Camera 1/27/99) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />Sam Light, City Attorney, read by title only, Ordinance No. 1292, Series 1999 - An <br />Ordinance of the City of Louisville, Colorado, Declaring an Emergency; Establishing a <br />Temporary Moratorium on the Processing of Applications for Approval of Preliminary <br />PUD Development Plans, Final PUD Development Plans, and Special Review Uses for <br />Properties Located Within "Downtown Louisville," as Defined Herein: and Creating <br />Certain Exemptions from the Moratorium. <br /> <br />Davidson called for staff presentation. <br /> <br />Paul Wood, Planning Director, stated that Ordinance No. 1292, Series 1999, <br />proposes the establishment of a temporary moratorium on the processing of <br />preliminary and final PUD development plan applications, as well as Special Review <br />Use applications within Downtown Louisville. The scope of Downtown Louisville <br />includes property zoned Commercial Community (CC), and Commercial Business <br />(CB) as reflected on Exhibit B, a map attached to the Ordinance. <br /> <br />As the Ordinance will have the effect of suspending some of the City' s zoning <br />ordinances, it has been drafted as an amendment to the zoning code, which is enacted <br />by ordinance rather than by motion or resolution. The Planning Commission held a <br />public hearing on February 9, 1999, and by a vote of 2:3 failed to support the <br />ordinance amendment. The Commissioners as a whole were in strong support of <br />adopting the Downtown Framework Plan and the Design Guidelines. However, there <br />was concern with the message that might be sent by the adoption of a moratorium, <br />and there was also concern with the fairness of the moratorium on currently pending <br />PUD applications, specifically in reference to 841 and 901 Front Street. <br /> <br /> <br />
