She also stated that she has visited with the neighbors and they are supportive of <br />the change. She closed by stating that the footprint of the home will not change. <br /> <br />Board Questions of Applicant: <br />Stuart discussed a concern that a condition might be needed to limit the material to a screen-type <br />material. <br /> <br />Cordell asked if the applicant had already received approval from the Architecture Review <br />Committee and if so, then, perhaps Conditions #1 is not needed. Cordell also asked the applicant <br />if she agreed with Condition #2. <br /> <br />Rogers stated that she already had the approval of the Architecture Review Board and that she <br />agreed with Condition #2. <br /> <br />Stuart asked if they ever experience stray golf balls in there yard and deck. <br /> <br />Rogers stated that they do have golf balls. <br /> <br />Stuart stated that perhaps the screening needs to allow the use of a glazing to afford protection <br />from the stray golfballs. He asked if they would be acceptable to staff. <br /> <br />McCartney stated it would be acceptable. <br /> <br />Chancellor asked to see the letter from the HOA regarding their approval of the project. <br /> <br />Cordell moved and Malmquist seconded a motion to enter the letter into public record. Motion <br />passed by voice vote. <br /> <br />Public Present in Favor of Application: <br />None heard. <br /> <br />Public Present in Opposition of Application: <br />None heard. <br /> <br />Applicant Closing Comments: <br />No additional comments. <br /> <br />Staff Closing Comments: <br />No additional comments. <br /> <br />Public Hearing Closed / Board Discussion: <br />Chancellor stated that the six criterion have been met, as well as the two conditions presented by <br />staff. He supports approval of the variance. <br /> <br />Malmquist, Cordell, Loeblich, Kelly and Stuart all stated that the six criterion have been met, as <br />well as the two conditions presented by staff. They all support approval of the variance. <br /> <br />Motion and Vote: <br />Chancellor moved and Malmquist seconded a motion to approve Case No. 06-023-V A: 116 <br />Springs Cove; Lot 88, Coal Creek Ranch Filing #2, Replat A amended. A variance request to <br />place an enclosed patio structure on the rear property line that abuts a drainage area (designated <br />open space) next to the Coal Creek Golf Course. <br /> <br />Roll Call Vote: <br />
