<br />Board of Adjustment <br />Meeting Minutes <br />OCTOBER 16, 2006 <br />Page 6 of 8 <br /> <br />Stuart, Kelly, Cordell, Malmquist, Loeblich and Chancellor all stated that they have done a site <br />visit, had no contacts with the applicant and no conflict of interest. <br /> <br />Loeblich asked the applicant, Mrs. Rogers, if she was prepared to move forward with the <br />hearing. Rogers replied that she was ready to move forward. <br /> <br />Public Notice Verification: <br />Schwertfeger verified the public notice requirements: published in the Daily Camera; posted in <br />City Hall, the Public Library, the Recreation Center and the Courts and Police Building; mailed <br />to surrounding property owners within 500 feet of the subject property; the property was posted <br />with the required signage and the appropriate fees were paid. Cordell moved and Malmquist <br />seconded a motion to accept the Public Notice Verification information as presented by staff. <br />Motion passed by voice vote. <br /> <br />Staff Presentation of Facts and Issues: <br />McCartney provided the following summary points of the October 16, 2006 Staff Report as <br />follows: <br />. The request is for a variance from the minimum 10-foot rear yard setback requirement. <br />. The subject property is within the Coal Creek Ranch Filing No.2, which is also known as <br />The Springs at Coal Creek Ranch. <br />. An existing porch (covered with a pergola) on the south side of the property encroaches <br />into the rear yard setback, next to an existing 20-foot utility easement. <br />. The property owner has proposed to take the existing covered porch and enclose it with a <br />"screened porch". The screened porch would be built in place of the existing covered <br />porch and would use exterior materials to match the existing structure - including roofing <br />materials. <br />. The room would be accessible from both the back yard area and the interior of the <br />existing home. <br />. It would not be heated; thought it would likely have electricity for lighting. <br />. Staff reviewed the application on the six criteria established under LMC Section <br />17.48.100 B. 1-6 and finds that all six of the criterion have been met. <br />. Staff is recommending approval of the variance request with the following two <br />conditions: <br />1) The applicant shall receive approval from the architectural review board of the <br />homeowner's association prior to approval of a Building Permit and said approval <br />should be submitted in writing at the time of applying for the building permit. <br />2) The enclosure shall not be provided with heat, or sewer / water service to function <br />for a four-season use. Electricity shall be allowed for interior lighting, etc. <br /> <br />Board Questions of Staff: <br />Stuart asked if only a screen type material would be used or could a glazed material be used. <br /> <br />McCartney stated that the applicant has indicated only a screen type material, where a glazed <br />material would insulate from the environment. <br /> <br />Applicant Presentation: <br />Rogers stated that a screen material will only be used because they want to screen the area to <br />control the bugs and stray golf balls. She noted that several homes in the area have roofs and <br />
