<br />Planning Commission <br />Meeting Minutes <br />SEPTEMBER 14, 2006 <br />Page 6 of 15 <br /> <br />Applicant Presentation and Commission Questions of Applicant: <br />Michael Markel, 5723 Arapahoe Av., Boulder, CO thanked Wood for the review of the <br />Preliminary Site Plan requirements and how those had been met within the Final application. He <br />continued with the following additional discussion points: <br />. During his review of the previous meeting tapes it was clear direction from the <br />Commission that the timing was not right for the inclusion of an Art Center. <br />. A mineral rights concern has come to his attention within the past 24 hours. The issue is <br />on the former Schempp Property and not on the Anderson Property. <br />. He discussed the 25% public use dedication. <br />. He reviewed the architecture / design guidelines used in planning the development as <br />follows: <br />y Review of the Louisville Market Type <br />y Request from the public for this type of market <br />y Single Family with Front Load Garage. The use of rear yards, court yards and <br />landscaping. Building Separation, the use of fencing and landscaping and front <br />porches. <br />y Single Family with Alley Load Garage. Discussed front and rear yard <br />landscaping. <br />y Row Houses <br />y Multi-family <br />y Commercial <br />y Open Space: fencing, play area / fields and pocket parks <br />. He stated that Markel uses the Build Green program that is Energy Star Rated. Which <br />means the following: 2x6 exterior wall construction, maximum insulation in ceiling (R- <br />31) and walls (R-21) and low water usage landscape? <br />. The conditions of approval are workable with the exception of condition #12. He <br />discussed the width of the trail as it borders the commercial area and how it is not <br />possible to get the full 30' when all the other design elements (road, parking, etc) are <br />factored into the design. <br /> <br />Deborski asked what type of fencing is planned to be used along the trail. <br /> <br />Markel stated it is an open 3-rail fence design. <br /> <br />Deborski stated that he would like to see the timeline for the completion of the entire trail system <br />and would specifically like to have the trails completed as part of Phase I. <br /> <br />Sheets asked if Markel was willing to put into writing the building of the trails. <br /> <br />Markel stated he could put that in writing. <br /> <br />Lipton stated that the trail building could be included as one of the completion items in the Letter <br />of Credit. <br /> <br />Members of the Public: <br />Jim Williams, 1616 17th St., #572, Denver, CO representing Magnolia Mineral and Trust <br />confirmed that the company and Markel are negotiating some of the outstanding issues regarding <br />the mineral rights. He stated he would leave a copy of the "Surface Use Agreement" for the City <br />to revi ew. <br />
