Staff reviewed the permit and based upon our code requirement to define <br />the shorter of the two lot frontages as the front setback, the permit was denied on June 14. Go ahead. <br />What really seems crazy to us is that we live on a corner lot, and the house is about 15 years old, <br />the house faces McKinley Avenue, we have a McKinley Avenue address, but the City of Louisville <br />does not recognize our front yard as our front yard. They recognize our side yard as our front yard. <br />And we have, I don't know if you have a copy of the letter, [Yes we were given just about everything <br />you have received] all we want to do is protect our kids and to make the neighborhood nicer. I don't <br />really have a lot more to say than that, it seems real crazy that after fifteen years our side yard is now <br />our front yard when the City of Louisville addresses our mail to McKinley but yet the City of Louisville <br />is saying our front yard is on Monarch when our address is on McKinley. <br />OK. <br />Thank you. Comments from board. <br />I took a look of the property a couple of times and as I asked Paul before, what is the purpose of this <br />regulation defining what's the front and what is the side and it would appear to me that it's main <br />purpose is to prevent someone from building a fence to obstruct views as you are driving by. I don't <br />see any other reason for it if you have one, I'd like to know, I just don't really understand it. The <br />house with the fence that they are going to build because of post were there do allow us to see if <br />there is going to be an obstruction and there does not appear to be any obstruction there. Also from <br />going around town, I noticed many similar situations just a few of which are a lot in Saddleback 1094 <br />1093 Hawk Court, 1096 Falcon, 556 Sagebrush, 549 Wildrose, Fireside and Centennial, Sunland in <br />McKinley, all these are corner properties which have six foot privacy fences. It appears to be a little <br />bit inconsistent. Now I didn't get out and measure these properties to see which one is actually <br />shorter than the other, but technically, from the reading of the law, if it is six inches shorter than it <br />makes one side and on the front. It doesn't make too much sense to me to stop them from going <br />ahead and building this, having small children myself, I know that a four foot fence is will not stop a <br />four year old from going over it. Especially the types of four foot fences that you see. Chain links, <br />split rails, if a child can see through it, there going to go over it. Whereas a six foot fence does <br />appear to at least stop my kids. They don~ climb all over the fence. If they are in the back yard they <br />stay in the back yard. As far as their other point, they have a what appears to be--what is that on <br />the side of your house is it a camper or a trailer? <br />We just recently poured a concrete pad for an air string. There are no covenants in Hillsboro North <br />and so we think, we thought that our side yard was our side yard and so we did not need a building <br />permit for that so we poured a concrete pad for the air string hoping we could cover it up and any <br />trailers with the six foot privacy fence but that was before we found out that our side yard was our <br />front yard. <br />Thanks, it appears to me that what their are trying is to beautify their neighborhood and not detract <br />form it. I don't think the, a four foot fence is going to accomplish that goal and just from going around <br />town I just noticed with many consistencies to this, at least in my opinion I think that we should grant <br />them the variance that they are requesting. <br />Anyone else, Dave? <br />Yes Paul, what about the view issue at that intersection- what's the required - there's a 30 foot <br />triangle on the side plan from the point of intersection of the corner of the two property lines, there's <br />an area there that should be 30 foot setback from that intersecting point connecting by the base of <br />the triangle. I'm not certain at this point what that dimension is if that clears at 30 feet - I think it's <br />
