STAFF PRESENTATION: Wood referred to the staff report of June 28, 1990. recommends denial of this variance. Staff Chairman Sears closed the public hearing. BOARD COMMENTS: Sears asked what the allowable coverage for R-E I' C' ') 0. Wood stated that the Grove was approved under a final development pI an which allows a cover age of 20%, because it was approved under a development plan there were var iances granted by the development pIan for setback. Smith asked if the applicant could put in a flag stone patio if they wanted without any problem or any variance? Wood stated that is correct. Swires asked if this house was already constructed when you purchased it'? CIark stated yes it was. Smith asked jf there was another access to deck three besides off of deck two? Clark stated no there isn't. Swires moved to approve the variance to allow for a 10' rear yard setback in lieu of the 20' rear yard setback and a requirement that a portion of deck number 3 next to the house be no more than one foot off the present lowest level of dirt at the back of the house, seconded by Ross. By Roll Call Vote Motion passed 4-0. Sears moved to amend the variance that would grant a variance for lot coverage not to exceed 25.1%, seconded by Smith. By Roll Call Vote Motion passed 4-0. C. MR. AND MRS. JIM SHAFFER - SETBACK VARIANCE Chairman Sears opened the public hearing. Notice was published in the Louisville Times June 13, 1990. APPLICANT'S PRESENTATION: Shaffer stated that they are requesting a variance for a 15 foot rear setback in order to construct a redwood deck. The rear yard is only 16 feet deep. The lot backs to the bike path and irriga- tion ditch. There are no structures within approximately 100 feet to the rear. Chairman Sears asked jf there was anyone that would like to speak
