• Residential Mixed -Use (MU-R) • Planned Community Commercial (P-C) • Permitted with Special Review Use: o Commercial Neighborhood (C-N) o Industrial (I) Natural Medicine Cultivation, Products Manufacturing, and Testing Facilities Summary The potential impact of Natural Medicine Cultivation, Manufacturing, and Testing Facilities are likely to be similar to manufacturing and light industrial uses already present in the city's industrial zone districts. As such, staff and the City Council believe that the use classification of Natural Medicine Cultivation, Manufacturing, and Testing Facilities is most appropriately aligned with a "manufacturing facility", generally defined in the LMC as facilities for the manufacturing, fabrication, processing, or assembly of products; provided that such facilities are completely enclosed and provided that no effects from noise, smoke, glare, vibration, fumes or other environmental factors are measurable at the property line. Under this draft ordinance, Chapter 17 of the LMC will be updated to define Natural Medicine Cultivation, Natural Medicine Products Manufacturing, and Natural Medicine Testing Facilities to align with State law and permit Natural Medicine Cultivation, Products Manufacturing, and Testing Facilities uses in the Industrial (I) and the Planned Community Industrial (P-I) zoning districts. General Regulations A new Section will be added to LMC Chapter 17.16 — General regulations, which will include the following updates: • A purpose statement defining the relevant State Statute as the Regulatory Act. • Requiring the 1,000-foot buffer from any child care center, preschool, elementary, middle, junior, or high school, or a residential child care facility, including a rule of measurement to determine compliance. • Restricting the operating hours of Natural Medicine Healing Centers to 8:00 AM to 10:00 PM. • Prohibiting Natural Medicine Businesses as a home occupation. Offenses Relating to Natural Medicine New Sections will be added to LMC Title 9 (Offenses Against Public Peace) related to Natural Medicine as included in SB 23-290. The provisions address underage possession of Natural Medicine, unlawful display or consumption of Natural Medicine, and the unlawful cultivation of Natural Medicine. Staff have included this Title 9 language for context and as part of the staff recommendation although this is not in Planning Commission's decision making scope. 5
