• Residential Mixed -Use (MU-R) <br />• Planned Community Commercial (P-C) <br />• Permitted with Special Review Use: <br />o Commercial Neighborhood (C-N) <br />o Industrial (I) <br />Natural Medicine Cultivation, Products Manufacturing, and Testing Facilities Summary <br />The potential impact of Natural Medicine Cultivation, Manufacturing, and Testing <br />Facilities are likely to be similar to manufacturing and light industrial uses already <br />present in the city's industrial zone districts. As such, staff and the City Council believe <br />that the use classification of Natural Medicine Cultivation, Manufacturing, and Testing <br />Facilities is most appropriately aligned with a "manufacturing facility", generally defined <br />in the LMC as facilities for the manufacturing, fabrication, processing, or assembly of <br />products; provided that such facilities are completely enclosed and provided that no <br />effects from noise, smoke, glare, vibration, fumes or other environmental factors are <br />measurable at the property line. <br />Under this draft ordinance, Chapter 17 of the LMC will be updated to define Natural <br />Medicine Cultivation, Natural Medicine Products Manufacturing, and Natural Medicine <br />Testing Facilities to align with State law and permit Natural Medicine Cultivation, <br />Products Manufacturing, and Testing Facilities uses in the Industrial (I) and the Planned <br />Community Industrial (P-I) zoning districts. <br />General Regulations <br />A new Section will be added to LMC Chapter 17.16 — General regulations, which will <br />include the following updates: <br />• A purpose statement defining the relevant State Statute as the Regulatory Act. <br />• Requiring the 1,000-foot buffer from any child care center, preschool, <br />elementary, middle, junior, or high school, or a residential child care facility, <br />including a rule of measurement to determine compliance. <br />• Restricting the operating hours of Natural Medicine Healing Centers to 8:00 AM <br />to 10:00 PM. <br />• Prohibiting Natural Medicine Businesses as a home occupation. <br />Offenses Relating to Natural Medicine <br />New Sections will be added to LMC Title 9 (Offenses Against Public Peace) related to <br />Natural Medicine as included in SB 23-290. The provisions address underage <br />possession of Natural Medicine, unlawful display or consumption of Natural Medicine, <br />and the unlawful cultivation of Natural Medicine. Staff have included this Title 9 <br />language for context and as part of the staff recommendation although this is not in <br />Planning Commission's decision making scope. <br />5 <br />
