<br /> City Council <br /> Meeting Minutes <br /> December 5, 2006 <br /> Page 6 of 21 <br />pro-rata basis as building permits are issued and the fees would be placed in a <br />jointly managed fund for acquisition of additional open space (either in fee or by <br />conservation easement) within the IGA plan area or the vicinity of Plan area. <br />Independent of the IGA requirements, any zoning request would also have to be <br />reviewed under the City Comprehensive Plan and Louisville Municipal Code. <br />The public hearing on the zoning application would be at a later date. <br />The proposed Amendment has been referred to the other IGA parties. The <br />Resolution notes that Louisville's signing of the Amendment is not to occur until <br />the other parties have first approved the Amendment. Ordinance No. 1456 <br />remains as a placeholder at the landowners' request. Staff requested another <br />continuance of the Ordinance and will have further information available at the <br />meeting regarding the continuance date. <br />Mayor Sisk opened the public hearing and asked that City Attorney Light's <br />comments be entered into the records. He requested an Applicant presentation. <br />Richard Lopez, 4450 Arapahoe Avenue, Louisville, CO representing the Hoyle <br />Family Trust, thanked City Attorney Light and the Boulder County Attorney <br />Hughes for their time and expertise in crafting the agreement. <br />COUNCIL COMMENTS <br />Council member Muckle asked if the negotiated $14,000 per acre fee could <br />actually purchase an acre of open space. Land Management Oirector Robson <br />stated $14,000 per acre is low for eastern Boulder County open space. <br />Mayor Pro Tem Brown noted this has been a long and arduous process. <br />Mayor Sisk noted the annexation was decided by the Boulder Oistrict Court and <br />the IGA amendment will assist in zoning the property. He agreed the negotiated <br />price for open space, dollar per dollar, probably would not buy open space. He <br />requested public comment and hearing none closed the public hearing. <br />MOTION: Mayor Pro Tem Brown moved to approve Resolution No. 56, Series <br />2006, seconded by Council member Marsella. All in favor. <br />MOTION: Mayor Sisk moved to continue Ordinance No. 1456, Series 2004 to <br />February 20,2007, seconded by Council member Muckle. Roll call vote was <br />taken. The motion carried by a vote, of 7-0. <br />CONDITIONS SURVEY & URBAN RENEWAL PLAN <br />(PUBLIC HEARING) <br />Mayor Sisk opened the public hearing and requested a City Attorney introduction. <br />
