The motion passed by a vote of 7-0. <br />RESOLUTION No. 56, SERIES 2006 - A RESOLUTION APPROVING THE <br />HOYLE PROPERTY AMENDMENT TO SOUTHEAST BOULDER COUNTY, <br />SOUTH 96TH STREET, DILLON ROAD AND US 287 AREA COMPREHENSIVE <br />DEVELOPMENT PLAN INTERGOVERNMENTAL AGREEMENT - PUBLIC <br />HEARING - (continued from 10/17/06) <br />ORDINANCE No. 1456, SERIES 2004 - AN ORDINANCE ZONING <br />PROPERTY KNOWN AS THE HOYLE PROPERTY - 2nd reading <br />PUBLIC HEARING <br />Mayor Sisk requested a Staff presentation. <br />City Attorney Light explained the Hoyle property is the 33.78-acre parcel on the <br />north side of Oillon Road and owned by the Hoyle Family Trust, and represented <br />by represented by Mr. Richard Lopez. Ordinance No. 1452, Series 2004, <br />approved on July 20, 2004, annexed the property to the City. The annexation <br />was completed after the Boulder County Oistrict Court ruled the property was an <br />enclave entitled to annexation. Upon annexation, the owners filed a request for <br />City Industrial zoning. <br />The property is designated as Rural Preservation Area under the Southeast <br />Boulder County, South 96th Street, Dillon Road and US 287 Comprehensive <br />Plan Intergovernmental Agreement i("IGA"). Under the IGA, Rural Preservation <br />Area parcels are intended to remain unincorporated and in a primarily agricultural <br />or very low-density residential character, pursuant to County zoning and <br />development regulations. The property is designated as subject to the IGA with <br />a preferred land use of Industrial under the Framework Plan of Louisville's 2005 <br />Citywide Comprehensive Plan. The Comprehensive Plan notes an IGA <br />amendment is necessary to effectuate the preferred land use for the property. <br />After annexation of the property the City Council directed staff to meet with Mr. <br />Lopez and Boulder County representatives to discuss options for a mutual <br />agreement regarding zoning of the property. <br />Those discussions resulted in a proposal to process the enclosed Hoyle Property <br />Amendment to the IGA and City Council previously gave direction to refer the <br />proposed Amendment to the other parties to the IGA. Under this Amendment, <br />the property may be zoned City Industrial upon arrangement being made for <br />payment of a fee of $14,000 per developable acre. The fee would be paid on <br />
