SUMMARY: <br />The applicant, Bob Redwine, is requesting approval of a variance from the 10 ft. side yard <br />interior setback in the Residential Estate (RE) zone district to allow a 6.1-ft. side yard <br />setback for a building addition. <br />BACKGROUND: <br />The subject property is located in the Scenic Heights Subdivision, which was approved by <br />City Council in 1959 and consists of single-family homes (Attachment 2). The existing <br />house was developed in 1971 and is subject to the RE zone district standards. There are <br />no applicable Planned Unit Development (PUD) standards, as the property was developed <br />prior to the City's requirement for the establishment of PUDs. This zone <br />district allowed for a 14-ft. aggregate side yard setback, with a minimum of 5 ft. on any one <br />side. A city-wide rezoning and update to yard and bulk standards occurred in 1976 with <br />Ordinance 1975-485. As part of the rezoning, the R1 zone district was removed and the <br />Scenic Heights neighborhood was placed in the Residential Low Density (RL) zone, which <br />required a minimum side yard setback of 7 feet. The change in zoning and subsequent <br />change in bulk standards in the Scenic Heights neighborhood were made evident by three <br />variance requests to reduce the minimum side yard setback from 7 ft. to 5 ft. between <br />1975-1979, which were all approved by the Board of Adjustment (BOA) (Attachment 3). <br />Between June 1992 and December 1993, the neighborhood was rezoned from RL to RE <br />as shown in Figure 1. The zoning change resulted in several nonconformities on the <br />property, including a nonconforming minimum lot size, lot width, and front yard setback. <br />These nonconformities are present throughout the subdivision and were the subject of two <br />additional variance requests to reduce side yard setbacks in the Scenic Heights <br />neighborhood, both of which were approved by the BOA between 2017-2020 (Attachment <br />4). <br />512 Sunset Drive Page 2 of 8 <br />BOA — August 20, 2025 <br />
