RESOLUTION NO. 4 <br />SERIES 1998 <br /> <br /> A RESOLUTION APPROVING <br />A FINAL SUBDIVISION REPLAT, FINAL SUBDIVISION PLAT, <br /> AND FINAL PUD DEVELOPMENT PLAN <br /> FOR THE BUSINESS CENTER AT CTC <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council by Etkin Equities, <br />Inc, a Final Subdivision Replat, Final Subdivision Plat, and a Final PUD Development Plan for <br />the Business Center at CTC; and <br /> <br /> WHEREAS, all materials related to the Final Subdivision Plat and PUD have been <br />reviewed by City Staff and the Planning Commission and found to be in compliance with the <br />Louisville zoning ordinances, subdivision regulations, and related policies; and <br /> <br /> WHEREAS, after a properly advertised public hearing concerning said Final Subdivision <br />Replat, Subdivision Plat and PUD Development Plan, the Planning Commission recommended <br />to the City Council disapproval; and <br /> <br /> WHEREAS, the City Council has considered the Final Subdivision Replat, Subdivision <br />Plat, and PUD Development Plan at its January 20, February 3, and February 17, 1998, meetings, <br />at which the applicant and other interested persons presented testimony, documents, and other <br />evidence to the City Council; and <br /> <br /> WHEREAS, the City Council has considered such testimony, documents and other <br />evidence made part of the record at such meetings and finds that said Final Subdivision Replat, <br />Subdivision Plat, and PUD Development Plan should be approved subject to the following <br />conditions: <br /> <br />Conveyance of Outlots B, C, D, E, F and G, shall be by Special Warranty Deed in a form <br />acceptable to the City. An ALTA title policy for the subject parcels shall also be provided <br />by the subdivider. <br /> <br />The PUD landscape plan shall be modified to correct the sidewalk alignment shown on the <br />typical entry plan. The note, and typical detail shall be modified to be consistent with the <br />final plat and PUD. The final landscape plan shall be modified to increase the calipers <br />for deciduous trees from 2" to 2.5", and ornamental trees shall be increased to 2" calipers. <br /> <br /> <br />
