o <br /> <br />o <br /> <br />o <br /> <br />o <br /> <br />The subdivider must fulfill its respective open space dedication obligation, as required by <br />annexation agreements for both the Mizel and Ward Annexations as well as the Subdivision <br />Agreement for the Colorado Tech. Center, Filing No. 1. The outstanding .6 acres land <br />dedication requirement shall be met by the addition of open space to the northwest comer <br />of Lot 5, Block 1. <br /> <br />The Final PUD shall be modified to reflect a 20' rear building setback running adjacent to <br />and parallel with the southerly line of Outlot D. Parking within the rear setback is permitted, <br />but must be fully screened from SH 42. Screening and buffering measures shall insure that <br />glare is not projected off premises from the parking lot. The 20' rear building setback shall <br />supersede other provisions of the Louisville Municipal Code pertaining to rear setback <br />requirements. <br /> <br />The final grading and drainage plan shall be approved by the Department of Public Works <br />prior to recording of the Final Subdivision Plat. <br /> <br />The phasing plan shall be revised to reflect that So. 104th Street be constructed by the CTC <br />Metro District in Phase I. In the event the District does not construct road improvements <br />the Subdivider shall be obligated to construct the portion of So. 104th Street, north of <br />Taylor Avenue when Taylor is extended to So. 104th Street in Phase II. The balance of <br />So. 104th Street shall be constructed in Phase III prior to the development of lots fronting <br />So. 104th Street. The Subdivider shall be required to execute a development agreement <br />and secure same with the required guarantee in a form acceptable to the City prior to the <br />issuance of building permits in the respective phases. <br /> <br />The Subdivider or his grantee will be required to convey fee title to the City for an <br />outlot to function as a pedestrian trail connection, utility and access easement at or <br />prior to PUD review for Lots 11 through 14, the width of which shall be agreed upon by <br />the subdivider, or his grantee, and staff and approved by the Mayor. <br /> <br />Subdivider shall convey easement parcels No. 1 - No. 4 by conservation easement deed <br />at or prior to the recording of the Final Subdivision Plat. The conservation easement deeds <br />shall be for conservation easements over the southerly 55' along SH 42 within Lots 16 <br />through 19, Block 1 inclusive, and Lot 1, Block 3. (The northerly 55' comprises outlots <br />E and F, to be conveyed in fee simple to the city), and for the 54' adjacent to South 104th <br />Street. <br /> <br />A conceptual grading and landscape plan for Outlot B and the 110 foot wide strip running <br />parallel with SH 42 and within Lots 16 through 19, Block 1, inclusive and Lot 1, Block <br />3, shall be approved at or prior to the recording of the Final Subdivision Plat. The <br />subdivider shall be required to landscape and maintain the full 110' (Outlots E and F and <br />easement parcel Numbers 1, 2, 3 and 4) width, and shall be required to landscape and <br />maintain Outlot B. Twenty percent of the net lot area of Lot 16 through 19, Block 1 <br />inclusive and Lot 1, Block 3 (exclusive of the 55' wide conservation easement parcels) <br /> <br /> <br />
