RESOLUTION NO. 3 <br />SERIES 1998 <br /> <br /> A RESOLUTION APPROVING <br /> A FINAL SUBDIVISION PLAT AND <br />A FINAL PUD DEVELOPMENT PLAN <br />FOR COAL CREEK BUSINESS PARK <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council by Trammell Crow <br />Development a Final Subdivision Plat and a Final PUD Development Plan for Coal Creek <br />Business Park; and <br /> <br /> WHEREAS, all materials related to the Final Subdivision Plat and PUD Development <br />Plan have been reviewed by City Staff and the Planning Commission and found in compliance <br />with the Louisville zoning ordinances, subdivision regulations, and related policies; and <br /> <br /> WHEREAS,after a properly advertised public hearing concerning said Final Subdivision <br />Plat and Final PUD Development Plan, the Planning Commission recommended approval with <br />conditions to the City Council; and <br /> <br /> WHEREAS, the City Council finds that said Final Subdivision Plat and Final PUD <br />Development Plan for the Coal Creek Business Park should be approved, with the following <br />conditions: <br /> <br />That the applicant agrees to formalize the commitment to participate in possible future <br />funding of McCaslin interchange improvements, including acknowledgment that they will <br />not protest inclusion in a possible special improvement district on the grounds that their <br />property does not benefit by such improvements, with, language to be incorporated onto <br />the Plat and in the subdivision agreement that is subject to approval by the City Attorney, <br />City Administrator, Applicant and Mayor; <br /> <br />That convenience retail stores, retail liquor stores and drive-through retail stores <br />(exclusive of banks) are added to the list of not permitted uses; <br /> <br />o <br /> <br />That Koelbel and Company execute a release of its reversionary rights, in a form <br />acceptable to the City, prior to the City's granting of any easement over Parcel S-3 for the <br />benefit of Coal Creek Business Park, and that once the release is recorded, the City grants <br />by separate instrument(s) a deed of easement to the owner, across Parcel S-3 for a <br />permanent easement and, to the extent required, necessary temporary construction <br />easement(s); <br /> <br /> <br />
