<br />City Council <br />Meeting Minutes <br />February 6, 2007 <br />Page 5 of 18 <br /> <br />Mayor Sisk read Ordinance No. 1508, Series 2007 and requested a Staff <br />presentation. <br /> <br />Planning Director Wood explained the Louisville Resource Conservation <br />Advisory Board (LRCAB) has initiated the following amendment to the Louisville <br />Municipal Code (LMC) to promote recycling. The amendment to Chapter 17 <br />would provide a section that defines regulations for the design and placement of <br />refuse and recycling areas in all zone districts that permit multi-family and <br />commercial development. <br /> <br />LRCAB modeled the ordinance using language from a Broomfield ordinance, <br />which requires refuse and recycling areas in new residential and commercial <br />developments and existing dl~velopments that are significantly remodeled. The <br />regulation would require the establishment of refuse and recycling areas, where <br />none had previously existed. In new developments to the City of Louisville, the <br />developers will be required to comply with these standards. There is language to <br />provide for existing developments, where refuse areas are insufficient, or where <br />no area has been established for recycling products. <br /> <br />The proposed language would require the placement of recycling dumpsters and <br />associated enclosures where developments "significantly remodel" fifty-percent <br />or more of the fair market value of their property. <br /> <br />The proposed amendment exempts developments where trash is picked up on <br />an individual basis. Staff is also requiring that these enclosure areas be <br />constructed with a concrete pad, as opposed to asphalt. The use of concrete will <br />prevent the areas from being crushed under the weight of the refuse trucks. <br /> <br />The Planning Commission conducted a public hearing on November 9, 2006, <br />received testimony and, following Commission discussion, voted to approve the <br />request by a vote of 6:0. The! Planning Commission forwarded a <br />recommendation of approval with the following condition: 1.) Upon approval of <br />the ordinance, Staff shall modify the Commercial and Industrial Design <br />Standards to reflect the new ordinance language. <br /> <br />PUBLIC COMMENT <br /> <br />Mark Persichetti, 1402 Taft Place, Louisville, CO, Chairperson of the Resource <br />Conservation Advisory Board, voiced his support of the ordinance. He outlined <br />the plan and thanked Eco-cycle for their assistance in preparing the ordinance. <br />He noted the ordinance would only apply to new structures in the City and not to <br />existing businesses. <br />
