The 2006 Budget calendar. <br />· Advertisement of Director of Land Management position. <br /> <br />City Manager Simmons reported the Colorado Municipal League hosted a <br />meeting concerning an item before the Public Utilities Commission relative to the <br />quality of services. Many municipalities throughout the state have issues with the <br />quality of services, and noted the City's recent negotiations with Public Service <br />relative to a new franchise agreement. CML proposes a forum for municipalities <br />to participate in the process and would assess 10 cent per capita fee for <br />participating municipalities. <br /> <br />Public Works Director Phare attended the meeting and reported 15 - 20 <br />municipalities were in attendance. There was unanimous support for the <br />contribution for participation. He explained the service issues discussed including <br />relocation and under grounding of services, late billing, and repairs and <br />replacement of street lights. The City of Louisville would be assessed $1,900. <br /> <br />Council member Van Pelt asked whether the $1,900 fee would be used for legal <br />fees. Public Works Director Phare confirmed it would be used for legal fees and <br />explained it is a formal quasi-judicial format, with filing and processing fees. <br /> <br />City Attorney Light stated his understanding that CML proposes to establish a <br />fund to defray the cost of legal actions against Public Service Company of <br />Colorado. CML will formally participate in the hearing process, including witness <br />testimony, and presentation of evidence of service issues. <br /> <br />Council member Van Pelt asked what would happen if Louisville did not <br />participate. Public Works Director Phare stated there would be a greater degree <br />of success if more municipalities participated. <br /> <br />Council member Van Pelt did not agree a fee should be charged to file a <br />complaint with the Public Utilities Commission. City Attorney Light stated a <br />complaint can be called into the PUC offices or filed in writing. He stated his <br />understanding that CML supports a unified effort at the PUC hearing. <br /> <br />Council member Van Pelt agreed there is strength in numbers. Mayor Sisk <br />concurred and stated Louisville should be represented at the Public Utilities <br />Commission hearing. There was Council consensus to participate. <br /> <br />City Manager Simmons reported the new Xcel Energy gas compressor station in <br />Louisville was denied. The City will continue discussions with Xcel on possible <br />upgrades to the Louisville station. He also reported on items for the August 2, <br />2005 City Council agenda include the following: The Comprehensive Plan; Use <br />Tax Resolution; Historic Preservation Ordinance and a proposed forestry <br />ordinance. <br />
