Staff <br /> recommended Council approval of the revised Ordinance. <br /> COUNCIL COMMENTS <br /> Councilor Keany asked why the Planning Commission will not have an opportunity to <br /> review the amended ordinance. Planning Director Russ explained a reasonable <br /> accommodations request has been presented to the City. City Attorney Light explained <br /> there is not a specific timeframe under the federal statute, but a request has been <br /> pending for some time. The applicant was told staff is waiting for City Council <br /> clarification on procedures. <br /> Councilor Keany asked if disability is a clearly defined category and noted his concern <br /> for the possibility of halfway houses or sex offenders' residents requesting reasonable <br /> accommodation in residential neighborhoods. City Attorney Light explained the City has <br /> a separate ordinance on sex offender's registry residences. The definition of disabilities <br /> in the Federal Fair Housing Act is the same definition used in the American with <br /> Disabilities Act. Persons protected by the statute have a major mental or physical <br /> impairment, which substantially limits a major life activity. <br /> Mayor Muckle requested public comment and hearing none, closed the public hearing. <br /> Mayor Muckle explained the ordinance outlines an administrative process, which will not <br /> be controversial and be used minimally. <br /> MOTION: Councilor Dalton moved to approve Ordinance No. 1611, Series 2012, <br /> seconded by Councilor Loo. Roll call vote was taken. The motion carried by a vote of <br /> 6-0. <br /> RESOLUTION No. 2, SERIES 2012—A RESOLUTION ESTABLISHING ADDITIONAL <br /> INCENTIVES FROM THE HISTORIC PRESERVATION FUND TO ENCOURAGE <br /> HISTORIC LANDMARK DESIGNATIONS AND NEW BUILDINGS OF CHARACTER <br /> FOR COMMERCIAL PROPERTIES IN THE CITY OF LOUISVILLE AND TO <br /> FACILITATE THE ASSESSMENT OF PROTECTED STRUCTURES (Continued from <br /> 10/18/11 and 12/20/11 and replaces Resolution No. 70, Series 2011) <br /> Mayor Muckle requested a City Attorney introduction. <br /> City Attorney Light read Resolution No. 2, Series 2012 and explained the Council <br /> reviewed Resolution No. 70, Series 2011 in October and in December.
