Louisville City Council Meeting <br />October 17, 2000 <br />Page 4. <br /> <br />EXECUTIVE SESSION <br /> <br />Davidson requested that Council go into executive session to discuss the possibility of a <br />lawsuit on the Fischer Annexation. <br /> <br />City Clerk Varra read Section 2.90.050 Public Statement of the Louisville Municipal <br />Code. <br /> <br />Sisk asked City Attorney Light if executive session is called when there is threat of <br />litigation or pending litigation. <br /> <br />City Attorney Light stated that in both circumstances, the open meeting ordinances states <br />that when pending litigation for a lawsuit is actually commencing, and any situation <br />where the person requesting the session believes in good faith that a lawsuit may result, <br />executive session may be called. <br /> <br />Mayer asked City Attorney Light if the City is justified in going into executive session. <br /> <br />City Attomey Light stated that it is his understanding the request for executive session is <br />to address specific legal questions regarding legal issues attached to the annexation and <br />zoning of the Fischer property. He stated that there are certain matters that are proper for <br />executive session. <br /> <br />VOTE: Roll call vote was taken. The motion failed by a vote of 5-1. Sisk voted no. <br /> <br />ORDINANCE NO. 1344, SERIES 2000 - AN ORDINANCE APPROVING AN <br />ANNEXATION, KNOWN AS THE FISCHER ANNEXATION, TO THE CITY OF <br />LOUISVILLE, COLORADO - 2na reading - public hearing continued from <br />September 19, 2000 (advertised Daily Camera 9/10/00) <br /> <br />Davidson called for City Attorney presentation. <br /> <br />City Attorney Sam Light read Ordinance No. 1334, Series 2000. <br /> <br />Davidson called for Staff presentation. <br /> <br />Planning Director Paul Wood stated that Ordinance 1344, Series 2000, if authorized, <br />would annex a 7.6 acre parcel known as the Fischer Annexation.
