South Boulder Road. Public Notice Certification: Staff reported the item had been continued from a previous meeting therefore a new notice was not required. Conflict of Interest: O’Connell and Lipton noted that O’Connell would not be able to vote on the item because of her absence from the previous meeting. They also noted it was not necessary for her to recues herself from the meeting. Staff Report of Facts and Issues: Russ reviewed the resolution of denial and requested discussion by the Commissioners. He noted the details for the denial are found in Section 3 on page 3 of the resolution. Commission Questions and Comments regarding the resolution of denial: Lipton thanked staff for the details of the resolution as well as complementing them on the summarization of the reasons for the denial in Section 3. Russell asked if another applicant comes forward will the same requirement of removing the Russian Olive trees be a requirement. Russ stated the trees are considered to be a nuisance and the City Forester will most likely make the same request of another applicant. The following sections were discussed: 1) Section 2 g: discussion about why the SRU was requested. It was concluded the phrase “the SRU request was being made because” should be deleted. 2) Section 3: each of the reasons (a, b and c) for denial were discussed. No changes were recommended. Public Comment: Sid Vinall, 544 Leader Circle, thanked the staff and the commissioners for all the work that has gone into the review of the project. He then made the following statements: There are 40 trees and shrubs in the lot which would be lost to this development. Looking west across the parking lot the mountains can be seen. The trees along South Boulder Road prevent the homes from being seen from the development site. He stated his awareness of three (3) microbreweries wanting to locate in Louisville and he suggested this site would be an excellent place to locate one of them.
