Louisville City Council Meeting <br />September 16, 2003 <br />Page 5 of 11 <br /> <br />RESOLUTIONNO. 28, SERIES 2003 - A RESOLUTION APPROVING THE <br />WILLOW RANGE TDR AMENDMENT TO THE U.S. 36 COORIDOR <br />COMPREHENSIVE DEVELOPMENT PLAN INTERGOVERNMENTAL <br />AGREEMENT AMONG THE CITY OF LOUISVILLE, THE CITY OF <br />BOULDER, THE TOWN OF SUPERIOR AND THE COUNTY OF BOULDER, <br />COLORADO - public hearing (Advertised Daily Camera 9/10/03) <br /> <br />Davidson called for Staff presentation. <br /> <br />Deputy City Manager Julie Boyd reported Boulder County requested the City consider an <br />amendment to the US 36 Corridor Comprehensive Development Plan Intergovernmental <br />Agreement. The amendment would permit the transfer of development rights for three <br />dwelling units on a parcel located on the north side of South Boulder Road in <br />unincorporated Boulder County, west of Louisville, to a parcel on the south side of south <br />Boulder Road. The proposal would preserve approximately 105 acres of open space land <br />with a conservation easement granted to Boulder and Boulder County. She explained the <br />property is located within the Rural Preservation Area under the US 36 Corridor CDP <br />IGA and are within the area of influence of the City of Louisville. The City of Boulder <br />will consider the IGA amendment on September 16, and the Town of Superior has <br />scheduled consideration at its next meeting. She noted the first line of the agreement <br />states that Louisville is a Colorado Statutory City. The Boulder County Attorney's office <br />will change the agreement to reflect that Louisville is a Home Rule City. She introduced <br />Pete Fogg of the Boulder County Land Use Department, who would address Council <br />questions. <br /> <br />Pete Fogg stated amendment to the US 36 IGA, addresses property within unincorporated <br />Boulder County. He explained the original application was received in 2000. A similar <br />proposal was received in 2003, which includes 5 units on the south of South Boulder <br />Road, and three units transferred from the north side of South Boulder Road. The County <br />Commissions have requested the parties in the IGA consider an amendment to the US 36 <br />Corridor Comprehensive Development Plan. He noted the City of Boulder's Planner has <br />recommended denial of the amendment to the IGA. The County Commissioners will <br />wait for the City of Louisville and the Town of Superior's decision before taking any <br />action on the application. Fog reviewed the Willow Ranch development, which is an 80- <br />acre site on the north side of South Boulder Road. A conservation easement of perpetuity <br />will be dedicated if the application is approved, resulting in a five-acre subdivision on the <br />south side of South Boulder Road. <br /> <br />Davidson opened the public hearing and asked if anyone in the audience wished to speak <br />for or against Resolution No. 27, Series 2003. There were no public comments. <br /> <br />COUNCIL COMMENTS <br /> <br />Sisk asked why the County is suggesting the development would be better on the south <br />side of South Boulder Road.
