Johnstone reviewed that at the April 3, 2001 meeting, City Council
continued Resolution No. 24, Series 2001 to May 15, 2001 to allow the Open Space
Advisory Board's review. The request was not reviewed by the Board in April, and is
scheduled for the May 21, 2001 meeting.

Mayor Davidson opened the public heating and called for Applicant presentation.

John R. Mehaffy, Martin & Mehaffy, LLC, 1655 Walnut Street, Boulder, CO, attorney
representing the applicants, requested that Resolution No. 24 of Substantial Compliance
not be continued. He asked that Council approve substantial compliance of the
annexation so that the process could move forward.

Mayer asked City Attorney Light if the Open Space Ordinance requires the Open Space
Advisory Board's review of this annexation and recommendation prior to City Council
approval of the substantial compliance.
