Louisville City Council Meeting <br />September 4, 2001 <br />Page 5 <br /> <br />Mayer commented that in the future, Council should be notified in advance of changes in <br />procedures. <br /> <br />Sisk called for Application presentation. <br /> <br />John Mehaffy, Martin & Mehaffy, LLC, 1125 Foxhill Drive, Longmont, CO, attorney <br />representing the applicant, reviewed the history of the property. He stated that the subject <br />property is 1.156 acres and the City recognized the possibility of future development of <br />the Maurer parcel when considering the Coal Creek Subdivision. He stated that the City <br />required Coal Creek Ranch subdivision to dedicate an access easement through St. <br />Andrews Lane, as alternative access to Dillon Road. He stated that the City further <br />planned for development of the Maurer property by requiring the Coal Creek Ranch <br />Subdivision provide water and sewer lines stubs to the property. However, the grade on <br />St. Andrews Lane was dropped substantially, making the previously dedicated easement <br />unusable. He stated that the applicants worked closely with the City Staff of Engineers to <br />identify alternative alignment for access. The Maurers explored development of their <br />property with the City, using the same density as the Coal Creek Ranch subdivision. He <br />stated that the City was not receptive to the development of four lots. The Maurers <br />explored development of two lots, and later decided to seek annexation with the City to <br />develop a single lot. <br /> <br />Mehaffy reviewed Section 16, Special Provisions of the Annexation Agreement: <br />A. Grant of Access Easement for a Private Drive to Connect to St. Andrews Lane. <br /> <br />B. Xcel Energy License Agreement - Authorizing Vehicles to cross the natural gas line. <br />C. Driveway Landscaping to Screen Private Drive from St. Andrews Lane. <br />D. Driveway Crossing Requirements, Signage, Access and Speed Bumps. <br />E. Trail Design and Dedication - submittal of Trail Design. <br />F. Dillon Road Access -Abandonment of Historical Access. <br />G. Architectural and Massing Guidelines - Disclosure of Type of Construction <br /> <br />Mehaffy presented four letters from adjacent homeowners who support the annexation <br />and zoning. <br /> <br />Sisk asked Mr. Mehaffy if he wished the letters entered into the record. Mehaffy stated <br />that he would. <br /> <br />PUBLIC COMMENT <br /> <br />Scott Johns, 813 St. Andrews Lane, Louisville, CO voiced concern over the driveway <br />easement, which crosses a bike path, and stated that the City should be compensated for <br />the easement. He asked that the applicant provide a trail to Dillon Road. He suggested' <br />that if the applicant withdraws his application, the City explore obtaining the property for <br />open space. <br /> <br />5 <br /> <br /> <br />
