Louisville City Council Meeting
October 2, 2001
Page 11

Mayer stated he wanted to clarify the difference in terminology between dedicated and
donated. Mayer stated that the 2.7 acres of park land is being dedicated, not donated.
Mayer stated that Council could have zoned this property SF-E with a maximum of five
lots on the entire property, but instead the applicant is getting 9 lots. The City, however,
is also ge. tting more park land than would otherwise have been required. Mayer stated
that, while he appreciates the efforts of the applicant, this is not a charitable donation; it is
a business deal in which both sides are benefiting.

MOTION: Brown moved that Council approve Resolution No. 48, Series 2001,
seconded by Levihn. Roll call vote was taken. The motion passed by a vote of 6-0. Sisk
recused.

Stephen Sparn asked Mayor Davidson and Council if they would be making a separate
motion to name the 2.7-acre park "Fischer Park."

Davidson stated that there is a separate process for the naming of parks in the City, and
that typically parks are named after prominent citizens and not necessarily after the
property owners.

Brown stated that he understood that the issue had been raised and recommended by the
Planning Commission. Davidson stated that it was not a matter to be determined by the
Planning Commission.

Mayor Pro-Tem Sisk returned to the meeting.

ORDINANCE NO. 1370, SERIES 2001 - AN ORDINANCE DISCONNECTING
FROM THE CITY OF LOUISVILLE, COLORADO, CERTAIN PARCELS OF
LAND LYING WITHIN THE GLACIER PARK, BOULDER COUNTY LAND
VENTURE AND TRILLIUM OPEN SPACE PROPERTIES - 1sT Reading - set
public hearing 10/16/01

City Attorney Light stated that this Ordinance is similar to one approved by Council
several months ago. This ordinance conveys the remaining portions of the right-of-way
parcels to be disconnected from the corporate boundaries of the City of Louisville.

MOTION: Keany moved that Council approve Ordinance No. 1370, Series 2001 on first
reading and place the ordinance out for publication and set the public hearing for October
16, 2001, seconded by Levihn. By unanimous consent, motion passed.

None.

CITY ATTORNEY REPORT

11
