Louisville City Council Meeting <br />October 2, 2001 <br />Page 6 <br /> <br />Davidson called for other Council comments. Hearing none, Davidson stated that no <br />action was required on this item as current policy is in place for these matters. <br /> <br />RESOLUTION NO. 48, SERIES 2001 - A RESOLUTION APPROVING A FINAL <br />SUBDIVISION PLAT AND PUD DEVELOPMENT PLAN FOR FISCHER <br />FARMS. <br /> <br />Davidson called for Staff presentation. <br /> <br />Councilman Sisk recused himself from the proceedings. <br /> <br />Planning Director Paul Wood stated that Resolution No. 48, Series 2001, if authorized, <br />would approve a Final Subdivision Plat and a Final PUD Development Plan for the <br />development of a 7.6-acre enclave located at 701 W. Spruce Street. Wood stated that the <br />applicant, JoBelle Fischer, and a representative of Fischer Farms, Stephen Spam of Sparn <br />Associates were present and are requesting approval by Council. <br /> <br />Wood stated that the Final Subdivision Plat, if authorized, would allow 9 single-family <br />lots. Final action by the Planning Commission occurred on September 20, 2001, and <br />recommended approval by Council at that time with two conditions. Only one condition <br />remains, the basis being compliance with the Plat with the provisions and terms of the <br />Annexation Agreement. The whole annexation process was initiated in May of 2000. <br /> <br />Wood reported that the Plat reflects substantial compliance with the density being 8 lots <br />plus 1, with the lot sizes at a minimum of 18,000 SF, and 20% maximum building <br />coverage. Wood stated that the Planning Commission supported the access option <br />reflected on the PUD, which eliminates the existing u-shaped drive in front of the <br />residence and provides a separate drive just for Lot 9 to West Spruce Street. Wood <br />continued that this option eliminated the excessive drive area within the front setback and <br />will reduce the number of vehicles that would cross the pedestrian/bike path. <br /> <br />In regard to open space dedication, Wood noted that the Annexation Agreement required <br />a 39% land dedication. Wood summarized that this would be accomplished in the form <br />of three outlots; Parcel A at 2.728 acres donated to the City without cost, Parcel B with <br />an area of 10,286 SF to be maintained by the HOA, and Parcel C with an area of 6,748 <br />SF, also maintained by the HOA. <br /> <br />Wood reported that during the preliminary review on June 12, 2001, the Planning <br />Commission required that the applicant submit a Phase I environmental assessment <br />report, which was received July 18, 2001. The assessment concluded that there were no <br />historical recognized conditions, however the report recommends, based on current <br />conditions, the abatement of; 1) detached single-car garage may have asbestos in the <br />exterior siding, requiring demolition permit approved by the State of Colorado; 2) <br /> <br />6 <br /> <br /> <br />
