<br />3. The "premises of the owner" is defined as the <br />residence of the owner, including the attached <br />property surrounding the residence that is <br />leased or owned by the owner, but not <br />including any common area, park or <br />recreational property jointly owned or leased <br />by the members of a homeowners or tenants <br />association. <br /> <br />4. No animal shall be deemed to be "running at <br />large" when the animal is enclosed within the <br />automobile or other vehicle of its owner. <br /> <br />5. NO DOG SHALL BE DEEMED TO BE "RUNNING AT <br />LARGE" WHILE UPON CITY-OWNED PROPERTY WHICH IS <br />DESIGNATED BY RESOLUTION OF THE CITY COUNCIL <br />AS A DOG-RUNNING AREA, IF THE DOG IS <br />ACCOMPANIED BY ITS OWNER, IS UNDER THE DIRECT <br />VOICE OR HAND CONTROL OF ITS OWNER, AND IS IN <br />COMPLIANCE WITH ANY POSTED REGULATION OR <br />RESTRICTION THAT HAS BEEN ESTABLISHED FOR THE <br />AREA BY RESOLUTION OF THE CITY COUNCIL. <br /> <br />Section 2. Any person who violates any provision of this <br />Ordinance shall be punished by a fine of not more than $1,000 or by <br />imprisonment not to exceed 1 year or both such fine and <br />imprisonment. Each day during any portion of which any violation <br />of any provision of this ordinance is committed, continued, or <br />permitted by any such person shall be a separate offense. <br /> <br />Section 3. If any portion of this ordinance is held to be <br />invalid for any reason, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each <br />part hereof irrespective of the fact that anyone part be declared <br />invalid. <br /> <br />Section 4. The repeal or modification of any provision of <br />the Municipal Code of the City of Louisville by this ordinance <br />shall not release, extinguish, alter, modify, or change in whole or <br />in part any penalty, forfeiture, or liability, either civil or <br />criminal, which shall have been incurred under such provision, and <br />each provision shall be treated and held as still remaining in <br />force for the purpose of sustaining any and all proper actions, <br />suits, proceedings, and prosecutions for the enforcement of the <br />penalty, forfeiture, or liability, as well as for the purpose of <br />sustaining any judgment, decree, or order which can or may be <br />rendered, entered, or made in such actions, suits, proceedings, or <br />prosecutions. <br /> <br />2 <br />
