Louisville City Council Meeting <br />November 6, 2001 <br />Page 6 <br /> <br />Keany asked if the ground lights on the sign monument would be on at all times. <br />Marceau stated that, at this time, there is no restriction. <br /> <br />Sisk asked Marceau if he was with Century Retail at the beginning of the project. <br />Marceau stated that he was not. <br /> <br />Sisk stated that the Final PUD was accepted without a monument sign in December of <br />1998. He stated his understanding of the merchants concerns, but asked if this would be <br />the last request to amend the PUD. <br /> <br />Marceau voiced his opinion that it is appropriate to come forward with this request at this <br />time. <br /> <br />Sisk stated his understanding that the PUD prohibited painted signage on windows. <br />Marceau agreed that window painting was an issue with Dairy Queen. <br /> <br />Sisk asked Planning Director Wood if the painted window signage at Dairy Queen was <br />addressed in the Development Guidelines. <br /> <br />Wood stated that the Commercial Development Guidelines do not address window <br />signage, and unless otherwise restricted on the PUD, is addressed in the underlying <br />Municipal Code, which stipulates the square footage limitation as 25% of the glazing <br />area. He stated that the 1998 PUD had varying limitations, however there was not a <br />prohibition on window signage, other than illuminated signage must be turned off at <br />10:00 p.m. or at the close of business. Neon window signs are prohibited facing or visible <br />from McCaslin Boulevard. <br /> <br />Sisk asked Marceau if he was asking Council to amend the PUD on signage to allow <br />illumination on signs all night, or if they would be turned off at 10:00 p.m. Marceau <br />stated that the signage would be turned off at 10:00 p.m., or at the close of business as <br />stated by Planning Director Wood. He asked if it would be appropriate to keep the lights <br />on all night. <br /> <br />Sisk asked Ms. Vessels, of Atlanta Bread, if she felt it was appropriate for the signage to <br />be turned off at the close of business. Vessels stated that would be alright. <br /> <br />Sisk asked Comfort Dental's representative, Cindy Kushner, if she felt it was appropriate <br />for the signage to be turned off at the close of business. <br /> <br />Kushner explained that they looked at different locations throughout Louisville but could <br />not be approved due to the zoning. She stated that if allowed, their sign would be on 24 <br />hours a day. She stated her company's philosophy that people will drive by buildings <br />after the close of business. <br /> <br /> <br />
