Louisville City Council Meeting <br />December 17, 2002 <br />Page 7 <br /> <br />Davidson requested that the City Clerk read the Public statement. <br /> <br />City Clerk Nancy Varra read Section 2.90.050, Public Statement of the Louisville <br />Municipal Code, which outlines the topics that can be discussed at an executive session. <br /> <br />Davidson moved that Council go into executive session to discuss pending litigation with <br />the City Attorney, seconded by Sisk. All in favor. <br /> <br />The Council adjourned to executive session at 7:50 p.m. <br /> <br />REGULAR BUSINESS ITEMS CONTINUED <br /> <br />Davidson reconvened the meeting at 8:12 p.m. <br /> <br />REPORT BY CITY ATTORNEY FROM EXECUTIVE SESSION <br /> <br />City Attorney Sam Light reported that; in executive session, Council discussed <br />pending litigation of the law suit entitled Centennial Valley Properties, II, LLC, The <br />Park at CTC, LLC, and the Park at CTC, III, LLC v. City of Louisville, Case No. <br />02CV902, Boulder County District Court, Div. 1. During the executive session the City <br />Attorney received direction with respect to potential settlement of that case. <br /> <br />Davidson reported that Council member Mayer left the Council meeting at 7:50 p.m. and <br />did not participate in the discussion at executive session. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />City Attorney Sam Light reported Mayor Pro-Tem Sisk, City Manager Simmons, and he <br />interviewed candidates for potential special counsel services with respect to land <br />acquisition. He noted the candidates were fine attorneys in the field of land acquisition. <br />Special Counsel is being sought to review the property rights of the 96th Street <br />Connection. Light stated the consensus of those interviewing was to recommend and <br />retain Robert Duncan, on an as needed bases, to advise and assist with respect to land <br />acquisition on the 96th Street Connection. <br /> <br />Sisk stated Mr. Duncan has experience in the condemnation field for 25 years. Duncan <br />represented the Town of Superior, and was very well recommended. Sisk asked that the <br />law firm receive the appointment rather than individual counsel. <br /> <br />MOTION: Sisk moved that Council appoint the law firm of Duncan, Ostrander and <br />Dingus, P.C., as special counsel, for advice on condemnation litigation and right-of-way <br />acquisition, as necessary, seconded Levihn. All in favor. Keany and Mayer absent. <br /> <br /> <br />
