Changes of location would be allowed, but the location would then <br />have to meet the distance requirements already in place. <br /> <br /> <br />Discussion centered on the impact to the current businesses and future impact if <br />the businesses converted to retail marijuana. <br /> <br />Carlson moved the Authority approve the proposed ordinance and direct staff to <br />present it to City Council. Rommelfanger seconded. All in favor. Lipton absent. <br /> <br />Authority Attorney Culley asked the members to consider fees to be charged for <br />transfers and changes of location. Wilson moved the fee consideration be left up <br />to staff with consideration for covering costs. Machado seconded. All in favor. <br /> <br /> C. Update/Discussion/Direction – Regulation of Retail Marijuana – <br /> Discuss setting a special meeting to review draft regulations on <br /> August 5, 2013 at 7:00 PM <br /> <br />Authority Attorney Culley asked the Authority members if they had any <br />recommendations before the draft ordinance is presented in August. The first <br />item was distance requirements. Some members were okay with similarity to <br />liquor with 500’ distance regulations. The conflict with actions by the Federal <br />enforcement was mentioned; there were letters written to establishments within <br />1000’ of schools. Other members were more concerned about the distance from <br />schools and suggested 1000’ from schools, etc. but expressed less concern with <br />distance from other retail marijuana establishments. There was suggestion of a <br />temporary cap on the number of establishments as a test. Currently, State law <br />will only allow conversion of current medical centers and new licenses will not be <br />issued until January 2015. Members were not in favor of rows of establishments <br />in the downtown area. <br /> <br />Authority members wanted to make sure the proposed taxes would be enough to <br />support both the administrative and enforcement costs. Sergeant Lanphere was <br />asked about increased burden on the Police Department. He stated there were <br />many variables, but there could be an impact on enforcement needs. Authority <br />Attorney Culley suggested to the members, fees for the application could be <br />considered to recover some of the cost. Authority members preferred a cost <br />analysis before any fees were set. <br /> <br />Authority members did not see a need to repeat background checks if the State <br />was conducting and sharing those results. They did see value in holding a public <br />hearing on the license application at the local level. <br /> <br />Machado moved the Authority hold a special meeting of the Local Licensing <br />Authority on August 5, 2013 at 7:00 pm in the City Council Chambers. Carlson <br />seconded. All in favor. Lipton absent.
