Local Licensing Authority <br />Minutes <br />August 5, 2013 <br />Page 2 of 4 <br />were not expressly given ability to add to those, but could include an <br />operating fee as addressed in the next talking point. <br /> <br />- Amount of operating fee – Staff suggested setting this fee at $1,500 which <br />closely resembles what is currently charged with medical marijuana. <br />Deputy City Manager Balser reported the Police Department has not had <br />significant concerns with the medical marijuana business currently operating. <br />With that in mind, there did not seem a reason to increase this amount. <br /> <br />Carlson liked the approach of setting this fee based on administrative and <br />enforcement needs and not just choosing the highest number. Authority <br />members agreed this amount seemed fair. <br /> <br />Authority Attorney Culley stated this would be an annual fee, so would apply <br />to renewals as well. <br /> <br />- No background checks for employees, just owners and managers – this is <br />how the state regulations are written. Authority Attorney Culley stated staff <br />discussed this and felt it was not necessary to do background on employees. <br />If a violation occurred, the Licensing Authority would have the ability to order <br />a show cause hearing. Authority Members agreed with staff’s assessment. <br /> <br />- Should there be a required minimum age for employees. Rommelfanger <br />suggested 21 years of age. Deputy City Balser reported there was no <br />requirement in the legislation, but it made sense to set it at the consumption <br />age. Authority members liked setting the minimum age at twenty-one. <br /> <br />- Should building inspections be done before the stores open. Authority <br />Attorney Culley stated the proposed local legislation currently contains an <br />inspection requirement before a license is presented to the Local Licensing <br />Authority and after the license is issued. Authority members agreed both <br />inspections were a good idea. <br /> <br />- Should there be some way to limit concentration, such as a cap within an <br />area. Planner I Robinson described the zone districts where retail marijuana <br />would be allowed. <br /> <br />Rommelfanger stated he did not want to see downtown filled with retail <br />marijuana shops. <br /> <br />Deputy City Balser reported there had been some conversation with Council <br />about the same issue. With what is currently in place, the 1000 foot distance <br />requirement from schools, etc. would not allow the businesses on Main Street <br />but potentially in other areas downtown. <br />
