Louisville City Council Meeting <br />June 4, 2002 <br />Page 13 <br /> <br />MOTION: Brown moved that Council direct Staff to proceed with the plans for the <br />Recreation Center, including the outdoor pool, and coordinate the bond issues for the <br />November 2002 election, seconded by Levihn. All in favor. <br /> <br />City Manager Bill Simmons stated that now that Council has given Staff direction on <br />how to proceed with the proposed expansion plan, he and the City Attorney would meet <br />with the financial advisor to review the various scenarios for the bond questions. He <br />anticipated providing information to Council at their June 11, 2002 study session. He <br />noted that the election calendar does call for setting any Tabor ballot questions by mid- <br />July. <br /> <br />ORDINANCE NO. 1385, SERIES 2002 - AN ORDINANCE AMENDING <br />CHAPTER 5.08 OF THE LOUISVILLE MUNICIPAL CODE TO ALLOW <br />LIQUOR LICENSEES TO PAY A FINE IN LIEU OF LIQUOR LICENSE <br />SUSPENSIONS IN CERTAIN CIRCUMSTANCES - 2nd reading -public hearing <br />(advertised Daily Camera 05/25/02) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1385, Series 2002. <br /> <br />Davidson called for Staff presentation. <br /> <br />City Clerk Varra reported that the Local Licensing Authority reviews and handles liquor <br />code violations on an individual basis and imposes penalties for violations of the <br />Colorado Liquor Code and Regulations and Louisville Municipal Code. The penalties <br />are established in the Rules of Procedure guidelines, which were revised on March 25, <br />2002. The suspension penalties represent guidelines only and are not binding on the <br />Authority. <br /> <br />The Colorado Department of Revenue, Alcohol Enforcement Division penalizes <br />violations of the Liquor Code through suspension and fines in lieu of suspension. The <br />proposed ordinance provides the local liquor licensee the option to petition for permission <br />to pay a fine in lieu of suspension for liquor code violations. The Authority has the <br />discretion to grant a petition for payment of a fine in lieu of a suspension or any part of <br />the suspension period. Currently, a suspension penalty for On-premises licenses <br />precludes the service of alcoholic beverages only, while licensed liquor stores are subject <br />to full closure. <br /> <br />The ordinance proposes to penalize the licensed establishment 20% of the estimated gross <br />revenues from sales of alcoholic beverages during the entire period of the proposed <br />suspension. Fines are limited to, not less than two hundred dollars and not more that five <br />thousand dollars. Payment of said fines are to be made in guaranteed funds and credited <br />to the general fund. Upon payment of said fine, the Authority shall enter an order <br />permanently staying the entire period of the suspension or that period not conditional <br /> <br />13 <br /> <br /> <br />
