Louisville City Council Meeting <br />August 6, 2002 <br />Page 11 <br /> <br />commitments to the NCWCD provide that the City maintain in the pipeline, a ratio of <br />one-third Windy Gap water to two-thirds CBT water. Acquisition of the Windy Gap units <br />would allow the City to acquire an additional 1500 CBT units and stay within the ratio. <br />He stated that acquiring Windy Gap units would not result in improving this year's water <br />supply. He noted that the Windy Gap Firm project is underway with the objective of <br />identifying a storage project of a size needed to provide for Windy Gap to have a firm- <br />yield during a drought. <br /> <br />Simmons explained that the transaction provides for Louisville to pay $3,300,000 to <br />Superior for their investment to date in the Windy Gap units. Additionally, Louisville <br />will be responsible for the on-going debt of the Windy Gap units, which is approximately <br />$23,000 per unit per year through the year 2017. He stated that the resolution provides for <br />the acquisition authorizing contracts for the six units and further authorizes Mayor <br />Davidson to negotiate any changes to the contract, as long as the essential provisions are <br />not altered. He explained that the Town of Superior's Board of Trustees will review this <br />matter at their August 19, 2002 meeting. <br /> <br />COUNCIL COMMENTS <br /> <br />Keany asked that the resolution clarify the Windy Gap units are owned by Superior <br />Metropolitan District I, rather than the Town of Superior. <br /> <br />City Attorney Light stated his understanding that the Town of Superior has taken control <br />over the Superior Metropolitan District I, but the entity still exists. The transaction will be <br />through the Superior Metropolitan District I, which is the current owner of the water <br />rights. <br /> <br />MOTION: Mayer moved that Council approve Resolution No. 27, Series 2002, <br />seconded by Keany. Roll vote was taken. The motion passed by a vote of 4-0.
