Louisville City Council Meeting <br />August 6, 2002 <br />Page 8 <br /> <br />City Attorney Sam Light read Ordinance No. 1396, Series 2002. <br /> <br />Davidson called for Staff presentation. <br /> <br />Deputy City Manager Julie Boyd reviewed Ordinance No. 1396, Series 2002, if <br />authorized, would ban smoking in enclosed public places and smoking in outside eating <br />areas. She noted that second reading of the ordinance is scheduled for August 20, 2002, <br />and restaurants owners and liquor licensees will be notified of the public hearing. She <br />stated that the effective date of the ordinance would be left blank to ensure that proper <br />notice can be given to local businesses. She noted that taverns were not exempted in the <br />ordinance. She explained that violations of the smoking ordinance would be <br />decriminalized municipal offenses and written into the municipal court. Enforcement of <br />the ordinance would be the responsibility of the police department. <br /> <br />City Attorney Sam Light reviewed the prosecuting attorney's comments and suggestions <br />relative to the smoking ordinance. <br /> <br />Davidson suggested that Council put the ordinance out for publication and consider <br />testimony at the public hearing on the provisions. <br /> <br />Keany voiced concem over the definition of public places that may include a park, <br />softball field, or bus stop as outlined by the prosecuting attorney. He stated that the <br />definition might be too broad. <br /> <br />MOTION: Davidson moved that Ordinance No. 1396, Series 2002 be amended in the <br />Sections of Intent and Enforcement, and sent out for publication, and a public hearing be <br />set for August 20, 2002, seconded by Keany. All in favor. Sisk, Van Pelt and Brown <br />excused. <br /> <br /> ORDINANCE NO. 1395, SERIES 2002 - AN ORDINANCE SUBMITTING TO <br /> THE REGISTERED ELECTORS AT THE NOVEMBER 5, 2002, SPECIAL <br /> ELECTION A BALLOT ISSUE CONCERNING CONTINUATION OF THE <br />CITY SALES AND USE TAX FOR OPEN SPACE ACQUISITION, <br />DEVELOPMENT, MAINTENANCE AND RELATED PURPOSES - 2nd reading - <br />public hearing (advertised Daily Camera 07/20/02) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />City Attomey Sam Light read Ordinance No. 1395, Series 2002. <br /> <br />Deputy City Manager Julie Boyd reported that approval of Ordinance No. 1395, Series <br />2002, would place a fourth question on the November 5, 2002 ballot. The question asks <br />the voters to continue the 3.75% city sales and use tax that is used for open space <br />acquisition. The tax is collected on all sales tax items, on vehicle registrations and <br />building materials used in non-residential construction. <br /> <br /> <br />
