Louisville City Council Meeting <br />October 15, 2002 <br />Page 5 <br /> <br />MOTION: Keany moved that Ordinance No. 1401, Series 2002 be approved, seconded <br />by Levihn. <br /> <br />Brown stressed the importance of the establishment of the Historic Preservation <br />Commission for the downtown area and for the citizens. <br /> <br />VOTE: Roll call vote was taken. The motion passed by a vote of 7-0. <br /> <br />RESOLUTION NO. 34, SERIES 2002 - A RESOLUTION SETTING FORTH THE <br />PURPOSES, TERMS, RESPONSIBILITIES, POWERS, DUTIES AND OTHER <br />MATTERS CONCERNING THE' HISTORIC PRESERVATION COMMISSION <br /> <br />Davidson called for Staff presentation. <br /> <br />Deputy City Manager reviewed that the resolution establishes the specific rules and <br />procedures of operation for the Historical Preservation Commission for the City of <br />Louisville. The resolution is structured on the requirements of the Colorado Historical <br />Society (CHS) criteria for a Certified Local Government (CLG). Passage of the <br />resolution by Council will not complete the requirements for CLG status, but creating the <br />commission pursuant to the qualifications in the resolution will be an important first step. <br />The CLG will still be required to adopt resolutions of ordinances as follows: <br /> Criteria and procedures for designation of buildings, sites, structures and districts <br /> · Definition of actions that require review by the historic preservation commission <br /> · Standards, criteria and procedures for review of alterations, demolitions or new <br /> construction in the jurisdiction of the CLG, which must be consistent with the <br /> Secretary of the Interior's Standards for Treatment of Historic Properties <br /> <br />CLG criteria specify that certain professional qualifications be met by at least 40% of the <br />members of the Commission. This requirement may be waived if those professionals are <br />not available. The City can begin advertising immediately for applicants to the <br />Commission and will include the criteria in the ads. <br /> <br />COUNCIL COMMENT <br /> <br />Sisk asked if the Resolution conforms to the Home Rule Charter, with respect to Section <br />2C - Removal from Commission. Boyd confirmed that the Resolution is compliant with <br />the Home Rule Charter. She stated that the Charter stipulates the reason for removal has <br />to be listed in the enacted ordinance or resolution. <br /> <br />Sisk noted the resolution was based on a model that has been used by other cities. <br /> <br />Boyd stated the resolution would assist the commission in setting policies, establishing <br />inventories, and recommendations on moving buildings and designating historic sights. <br /> <br />5 <br /> <br /> <br />
