NONE

Davidson closed the public hearing and called for Council comments or motions.

Sisk moved that Council approve Resolution No. 25, Series 1996, a Budget amendment for the 1995
open incumberances. Seconded by Lathrop. Roll call was taken. Motion passed by a 7 - 0 vote.

RESOLUTION NO. 26, SERIES 1996 - RESERVING PART OF THE FUND BALANCE OF
THE CAPITAL PROJECTS FUND FOR THE FUTURE DEVELOPMENT OF A
COMMUNITY PARK

Dianne Ray, Finance Director, stated that during the 1996 Budget process it had been determined that
certain amounts be set aside specifically for the development of a community park. This was done
through the Capital Improvements program. A schedule had been set for the next four years of
amounts they would like to have designated. This is for the amount of $100,000 from the 1996
Budget through the Capital Project Fund. She stated that the money will not be spent until the
amount accumulates over several years. Council will then designate how the money will be spent.

Davidson stated that the Finance Committee had reviewed this and recommended its approval.

Howard moved that Council approve Resolution No. 26, Series 1996, designating part of the Fund
balance of the Capital Projects Fund for the future development of a community park. Seconded by
Sisk. Roll call was taken. Motion passed by a 7 - 0 vote.

RESOLUTION NO. 27, SERIES 1996 - APPROVING AN AMENDMENT TO A FINAL PUD
DEVELOPMENT PLAN FOR CHENG'S GARDEN

Paul Wood, Planning Director, stated that this amendment was requested because upon inspection
of the building staff had noted a series of exterior wall fixtures that were not authorized as part of the
PUD. The lenses of the fixtures had been frosted to reduce the glare. They have a 13 watt
fluorescent bulb, which is equivalent to a 60 watt incandescent. Planning Commission approved a
resolution forwarding this to Council.

Davidson called for the applicant's presentation.

Steve Wells, representing Cheng's LLC, explained that he had never seen the original PUD. They had
a set of the Building Department drawings, which departed from the PUD drawings in that they
showed these lights. The discrepancy was not caught until the lights were on the building.

Davidson called for Council questions or comments.

Mayer had seen the frosted lights at night and felt they were acceptable.

5
