The intent of the easement was to <br />provide utility service to future development on each of the four lots. In 2013, the <br />Louisville City Council approved a Planned Unit Development (PUD) for Etkin Johnson <br />to construct a single development on all four Tots, eliminating the necessity for the 20- <br />foot drainage and utility easement. No utilities have been placed in the easement and <br />drainage is being provided at another location on the property. The Public Works <br />Department has reviewed the request and determined the easement is no longer <br />necessary. There is no fiscal impact to the City of Louisville associated with vacating <br />the existing 20 -foot utility easement. Staff recommended Council approval of Ordinance <br />No. 1667, Series 2014. <br />Mayor Pro Tem Dalton opened the public hearing and requested public comment and <br />hearing none, closed the public hearing. <br />MOTION: Council member Lipton moved to approve Ordinance No 1667, Series 2014 <br />on second and final reading, seconded by Council member Stolzmann. All were in <br />favor. Roll call vote was taken. The motion carried by a vote of 5 -0. Absent: Mayor <br />Muckle and Council member Keany <br />ORDINANCE No. 1668, SERIES 2014 - AN ORDINANCE REPEALING <br />CHAPTER 8.48 OF THE LOUISVILLE MUNICIPAL CODE PERTAINING TO <br />MECHANICAL AMUSEMENT DEVICES -1st Reading — Set Public Hearing 7/1/14 <br />Mayor Pro Tem Dalton requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance No. 1668, Series 2014. Staff recommended <br />Council approve the ordinance on first reading, order publication and set a public <br />hearing for July 1, 2014. <br />MOTION: Mayor Pro Tem Dalton moved to approve Ordinance No. 1668, Series 2014 <br />on first reading, ordered it published and set a public hearing for July 1, 2014, seconded <br />by Council member Stolzmann. All were in favor. Absent: Mayor Muckle and Council <br />member Keany. <br />CITY ATTORNEY'S REPORT <br />City Attorney Light pointed out if Council wishes to have any questions on the <br />November ballot, they must provide notification to the Boulder County Clerk by the end <br />of July. <br />COUNCIL COMMENTS, COMMITTEE REPORTS, AND IDENTIFICATION OF <br />FUTURE AGENDA ITEMS <br />Council member Stolzmann reported on the Consent Agenda, Council welcomed Steve <br />Domenico, a new member to the Sustainability Advisory Board. <br />
