Sec. 17.14.090.A.2.b.ii.c of the LMC: On a case by case basis, the <br />City may approve alternative street design that varies from the City's adopted public <br />street cross sections. <br />Staff recommendation: Staff recommended approval of the requested SRU, Final Plat <br />and Final PUD for the DELO development. Staff determined the waivers are <br />reasonable under the Louisville Municipal Code to allow for an effective development <br />given the location and surrounding land uses. Staff also determined the applicant has <br />met all the conditions required in the preliminary approval. <br />Staff recommended conditions of approval: <br />1. Should a regional offsite detention basin be created to detain the drainage of the <br />Highway 42 development (including Phase 1 and Phase 1A), the project must <br />include a community garden as shown in the original plans. <br />2. If an off -site regional detention pond is not approved, the detention basin and <br />public gathering space located in Tract G, Tract H and within the E. Lafayette <br />Street right of way shall be constructed with stairs stepping down from Cannon <br />Street through the proposed retaining walls to make this space more publically <br />interactive; further the stairs should be a minimum width of 50 feet along <br />Cannon Street, or an alternative design approved by City staff that is open and <br />accessible. <br />3. The applicant shall submit a public art master plan with Phase 2, showing how <br />public art/signage will be integrated throughout the development. The public <br />art/signage should reflect the previous historic use of this area for the Louisville <br />Rod and Gun Club. <br />4. The applicant shall work with City staff to identify ways to minimize up -light <br />issues while maintaining the historic nature of the lighting fixtures. <br />4.5 The applicant shall process a right -of -way vacation application for vacation of <br />the originally platted North Front Street right -of -way. If the plat will be recorded <br />prior to final effectiveness of the vacation ordinance, revise the plat sheets to <br />designate the original platted right -of -way as "to be vacated by separate <br />ordinance." If the vacation is not affected, a maintenance agreement shall be <br />required to provide for private maintenance of the right -of -way. <br />COUNCIL COMMENTS <br />Council member Lipton questioned condition #3, which requires the applicant to provide <br />a public art master plan with Phase 2. He did not recall the City Council enacting an <br />ordinance requiring development to provide public art master plans. Principal Planner <br />McCartney explained there is a discussion in the MUDDSG about public art and <br />because the applicant mentioned public art in their PUD, but did not show it in Phase 1, <br />the staff is requesting it be shown in Phase 2. <br />
