Chris Pritchard asked if the Applicant would have to tie something to the title so that this <br />landscaping solution would pass on if the property changes hands? If it is stated on the PUD, it <br />goes with the property. <br /> <br />Betty Solek asked about the shrubbery around the building. She is concerned about the quantity <br />of Winged Euonymus and would like to see some variety. <br /> <br />Bill Boulet asked how much R&D they anticipated to house in this building, and what types of <br />rooftop units they might need? They are marketing to a variety of uses, and there is no way to <br />know who will rent. The Applicant pointed out where he thought the rooftops might go. Mr. <br />Boulet thinks it is a good project. <br /> <br />Russ Van Nostrand feels the project is good. He thinks the landscaping will work out. Sarah <br />Klahn agrees with Mr. Boulet and Mr. Van Nostrand. <br /> <br />Staff Summary: <br /> <br />Staff Recommends approval with 12 conditions. There is a correction to #4: it reads the <br />“eastern,” but should read the “western.” Regarding Condition #5, Staff would like the condition <br />to read: That the 25% minimum landscape coverage requirement is met, exclusive of the railroad <br />easement, with some of that additional landscaped area located adjacent to the north and south <br />sides of the building; OR alternatively that if the easement is vacated, prior to building permit <br />application, in a manner that allows plant materials to be installed in that area, that the plan <br />shall be approved as shown. On Condition #6, the following will be added to the end: with <br />appropriate cost recovery available from the adjacent property owner to the north. <br /> <br />Applicant Summary: <br /> <br />Thanks to everyone. The Applicant would like to void Condition #6, because in the event that the <br />railroad easement is not vacated, he will be adding the landscaping on his site, and doesn’t want to <br />develop the railroad easement at a later date. <br /> <br /> <br />Public Hearing Closed/Commission Discussion: <br /> <br />Mr. Lipton makes a motion to approve Resolution No. 4 with the 12 Staff Conditions, with the <br />following notes: in Condition #4, strike the word “eastern” and add the word “western;” and <br />Conditions #5 and #6 to be modified as written above in the Staff Summary. Ms. Solek adds an <br />amendment to Condition #8; add Spring flowering perennials to perennial beds, and substitute <br />shrubs with variety of flowering times and Fall foliage for 167 Winged Euonymus shown on the <br />landscape plan. Mr. Lipton approves and seconder agrees. Robert McAllister asks for <br />clarification.
