D. Resolution No. 3, Series 1999, American Variseal Final PUD and Minor
Replat, Lot 3, part of Lot 4, Block 1, Park at CTC for a light industrial
building.

Staff Certification/Planning Commission Disclosures:

This Resolution was fully noticed for the December 9th meeting. As a courtesy, notice was
republished the Louisville Times and was posted in City Hall. All Commissioners were either
familiar with the property or had made a site visit.

Staff Report and Facts and Issues:

Staff gave a brief overview of the proposal. The Resolution was continued after full discussion in
December, due to architectural questions that could not be resolved. Phase II is not being
approved tonight which is duly noted on the proposal.

Commission Questions:

Betty Solek asked if Staff had seen the proposed metal siding. No they have not - a sample will
be viewed tonight. Robert McAllister wants to know whose responsibility it is to provide the
design standards for CTC. It is Staff’s responsibility, and a meeting is planned this month to
begin working on citywide guidelines. Betty Solek asks Craig regarding the City standards for
using porous paving for fire access roads. Craig feels it has been used in the past, and it should be
verified with the Fire Marshall to confirm that it is acceptable.

Applicant’s Presentation:
Steven Walsh with RNL Design made introductions for the Applicant. Thanks to Staff and the
Commission. Focus has been to satisfy the numerous conditions and answer concerns regarding
the building materials. Kent Freed, landscape project manager, went through the landscape
conditions including lighting. The Applicant is asking for approval of the plans as submitted
regarding the exterior lighting, but they will not make it a sticking point. Bill Ademe, Project
Manager and Architect for American Variseal spoke regarding architecture, including the intended
materials.

Public Comment:

None.

Commission Questions:

Bill Boulet asked what the Applicant’s problems are with conditions #5 and #6.
