Commissioner Klahn asked about the view of the tower from Old Town Louisville and that the
height may be too much. She would like to see a model of the tower with it showing how it
would look at night with the light coming through.

Commissioner Lipton does not care for the tower and would like to see that taken out of the
project. He is concerned about the parking. Lipton doesn’t think that property owners should
look to other property owners to help with parking issues. He would like to see a better
requirement.

Staff Summary:

Mr. Johnstone stated that the Staff is recommending approval with the revised Resolution No. 35,
provided at the meeting with 13 conditions of approval.

Applicant Summary:

Mr. Schneider thanked the Planning Commission for their time and hopes that the PC will
consider the tower visually inside.

Public Hearing Closed/Commission Comment/Vote:

Commissioner Lipton proposed a motion that would approve the development plan as presented
without the tower but also leaving the door open for the applicant to come back and provide an
alternative to another tower design or other architectural element design. Lipton also suggested
putting in a condition in some kind of cross-parking arrangement with other owners.

Commissioner Klahn likes the project and is also concerned about the tower. She thinks that
something could be worked out with the tower.

Chairman Boulet agrees with the applicant that the tower would add a sense of drama for patrons
as they were walking into the project. He is concerned with what the tower will look like during
the day and night. He agrees to let the applicant come back with another design. A tower may
not be the way to go for the dramatic experience for the customer. He also agrees that a parking
agreement would be a good idea.

Commissioner Pritchard is in favor of the tower and thinks it adds character to the building. He
knows that the concerns of the illumination can be addressed so that light will not be seen on the
outside of the building.

Commissioner Thompson is also in favor of the tower element.

Commissioner Pritchard is concerned that if the tower is taken off, the applicant may have to
change the whole building.

5
