Mr. Walsh stated that they agree with the terms of approval at this time. He asked for
clarification of the 1041 permit, they would like some level of determination of the definitions
quickly so that they can respond. He also asked about the shared access.

Craig Young explained where they will put the detention on this project and that there would be
extra parking on the site if there was shared access, however, the owner of the site adjacent to
them may be put through some tough civil engineering challenges if they went that way.

Todd Schneider, President of the Overlook Land Company, passed out a color rendition of the
restaurant out to the PC. Mr. Schneider stated that there are not a whole lot of banquet facilities
in the area.

Members of Public:

None.

Commission Questions:

Commissioner Pritchard asked what the Staff’s thoughts are about the drainage. Johnstone stated
that Staff’s concern is the design and how it relates to the street, and putting an access this close
to the property line as a second access point that there is an impact on the adjacent property
owner. If the adjacent property owner is okay with that then there would not be a problem.

Mr. Schneider has talked to the adjacent property owner, George Topakis, regarding the grading
but not about access at this time.

Pritchard asked what that time frame is for the 1041 Permit. Johnstone does not know the time
frame at this time. It will be made cautiously.

Chairman Boulet asked if the tower element is to function as a skylight. Schneider stated that it
will be a skylight.

Boulet has two concerns with the tower, one, that light might come through it at night and the
other is the height of the tower. Boulet asked if they would be able to scale the tower down.

Mr. Walsh stated that they would be able to scale the building down and show the PC an example
of the light source that they are proposing. The level of the illumination would be minimal.

Boulet asked if they would be able to go with an internal blind to ensure that there is no light
spillage.

Walsh proposed a light blocking system inside the glass tower.

4
