<br />recommends as a condition of approval that the Subdivider shall fully vacate or relocate the <br />roadway portion of the 30-foot wide roadway and utility easement across Lots 11 and 15. <br />Further, if the roadway portion of the easement is relocated, then the Subdivider shall be required <br />to complete road improvements to Boxelder St. and CTC Boulevard north of Boxelder St. prior <br />to the relocation of the roadway easement. <br /> <br />Wood also noted that the Subdivider is eligible to receive recovery from the Bennett Parcel <br />toward 50% of the costs of right-of-way acquisition as well as 50% of the costs of road <br />improvements based upon the linear property frontage on Boxelder and CTC Boulevard. <br /> <br />th <br />South 104 Street Connection: <br />Referencing the Subdivision Plat, Wood discussed the dedication and additional 35-feet of right- <br />th <br />of-way for South 104 Street. Wood noted that the dedication does not extend all the way to <br />Cherry Street. As a condition of approval, Staff recommends that prior to recordation of the <br />subdivision plat that the CTC Metro District convey the required additional right-of-way for <br />th <br />South 104 Street and secure the associated public improvements through the CTC Filing No. 2 <br />Subdivision Agreement. If the District is unable to fulfill this condition, then the Subdivider shall <br />be required to fulfill the condition prior to the recordation of the subdivision plat. <br /> <br />Public-Use Dedication: <br />Wood reported that the Subdivider is proposing to meet the required public-use dedication <br />requirement through both the dedication of a conservation easement, and a cash-in-lieu of land <br />dedication payment. There is a 12% required public-use requirement for this property, which is <br />approximately 8.6 acres. Wood reported that the subdivider is proposing to dedicate a 54’ wide <br />th <br />conservation easement parallel with and adjacent to South 104 Street, which would yield <br />approximately 2.6 acres. Wood explained that the Subdivider is entitled to an off-site credit of <br />0.18 acres from Lot 15, Block 1 of the Business Center at CTC. Wood reported that the <br />remaining 5.28 acres would be inform of a cash-in-lieu payment based upon a value of $35,000 <br />per acre. <br /> <br />Wood reviewed the public-use dedication requirements recommending that the Commission <br />prepare a recommendation to the City Council because they have the final authority in directing <br />how the applicant meets its public-use dedication requirement. <br /> <br />Plat / PUD Modifications: <br />Wood reviewed four-plat modifications that are necessary prior to review by City Council. He <br />reported that those are one of the conditions of approval. <br /> <br />Rezoning: <br />Wood stated that the rezoning request is for a portion of the subject property as previously <br />reported and staff does find that such rezoning serves a beneficial purpose in avoiding a situation <br />where lots contiguous to Lot 12 would have a dual zone designation. Staff supports the rezoning <br />request to align the limits of the zone district with actual legal description of the platted parcel. <br /> <br />Wood reported that staff recommends approval of the final subdivision plat, PUD development <br /> <br />6 <br /> <br />
