Planning Commission <br />Meeting Minutes <br />AUGUST 11, 2005 <br />Page 8 of 15 <br /> <br />Staff Report of Facts and Issues: <br />Wood provided the following summary: <br />A final PUD amendment to Crystal Estates PUD (Fordyce Auto Center) to expand <br /> <br /> <br />the auto body repair, lube center, office and reception area by 1,820 SF and to <br />construct an additional 3,055 SF of auto body repair, brake/muffler service and <br />office waiting area in an adjacent building. <br />Hearing was continued from the July 14, 2005 public hearing. <br /> <br /> <br />The applicant was directed to respond back with a compliance plan for the <br /> <br /> <br />meeting which would: <br />Show how the applicant would propose to park and screen vehicles <br /> <br /> <br />outside an enclosed structure which are awaiting repair. <br />Reflect where such vehicles would be parked during construction of the <br /> <br /> <br />new building. <br />Staff had communicated to Stewart Architecture the need for the plan, its contents <br /> <br /> <br />and the desire to receive that for incorporation into the meeting packet. The <br />applicant did not respond with such a plan. The applicant also did not respond to <br />any of the recommended conditions of approval. <br />The new building is to be used primarily for brake and muffler repair. <br /> <br /> <br />At this time, there is no limitation on the PUD which would prevent the building <br /> <br /> <br />from being used for auto body repair. <br />The applicant is proposing to complete an expansion of the current auto body <br /> <br /> <br />shop by 1,850 SF. <br />The Engineering and Planning Divisions are requesting that the applicant be <br /> <br /> <br />required to shift the location of the access drive into the property from Cannon <br />Circle 35 feet to the west, which would provide the separation needed between the <br />access drive and HWY 42. <br />The Planning Division is also requesting the applicant to complete the access <br /> <br /> <br />modification at the same time Cannon Circle improvements are completed in <br />accordance with the obligations set forth in the Crystal Estates Subdivision <br />Agreement. <br />Wood provided the following recommendation summary: <br />Four of the five required SRU criteria have not been met. <br /> <br /> <br />The request is not in conformance with the adopted Comprehensive Plan with <br /> <br /> <br />regard to the impacts of the use on adjoining conforming uses. <br />The request does not demonstrate how the anticipated impacts of the emission of <br /> <br /> <br />noise, vibration and dust will be mitigated on adjoining residential uses. <br />The request does not demonstrate adequate off-street parking. <br /> <br /> <br />It does not demonstrate how an expansion of an auto body shop and auto repair <br /> <br /> <br />services will be compatible with both existing and future residential uses located <br />to the south. <br />Wood reviewed the seven (7) conditions of approval if the Planning Commission <br />approves the request, as follows: <br /> <br />1.In conjunction with the Final PUD/SRU review, the applicant shall execute and <br />record a covenant and agreement to hold Lots 1 and 2 as one parcel.
