City Council <br />Meeting Minutes <br />November 3, 2014 <br />Page 4 of 18 <br />The Interpretive Park includes the following: 2,348 SF Interpretive Park; bench and <br />interpretive sign; landscape area and public art. The developer will maintain the Park <br />for two years. <br />Fiscal Impact: The project should have negligible fiscal impact on the City because it is <br />currently served by right -of -way and utilities. The developer will pay for water taps, <br />sewer taps, the construction of a sidewalk, interpretive park (includes maintenance for <br />first two years) and a private alley, which will be maintained by a Home Owners <br />Association. <br />The Planning Commission held a public hearing on October 9, 2014. The Commission <br />agreed this project was the right density for this location. They believed the waivers <br />were justified through the dedication of public land. They questioned the request to <br />remove the accessory structures from the overall lot coverage and floor area <br />calculations, but realized the size of the development was more appropriate than a <br />multi - family complex. The Planning Commission voted 6 -0 to recommend the City <br />Council approve the application, with staffs recommended conditions. <br />Referrals: <br />• Boulder Valley School District (BVSD): 2 students to LES, 1 student to LMS, 1 <br />student to Monarch <br />• Louisville Fire Protection District (LFPD): 20' wide access <br />• Historic Preservation Commission (HPC): Likes marker, archaeological <br />monitoring, appreciates alley access, does not agree with waivers <br />• Horticulture and Forestry Board (HFAB): Does not believe area is large enough <br />for park <br />• Parks Department: Believes park is pilot project for future similar sites <br />Staff recommendation conditions for Resolution No. 68, Series 2014. <br />1. The applicant shall continue to work with Historical Commission to ensure the <br />information shown on the interpretive sign is sufficient for interpretive purposes. <br />2. If City Council approves the floor area waiver, staff recommends the deed <br />restriction be expanded to prohibit any second floor construction on detached <br />accessory structures, including garages. <br />3. The applicant shall include a note on the PUD, which states "Hutchinson Corner <br />LLC shall pay for an archeological survey and excavation monitoring of the Acme <br />Mine Shaft." <br />COUNCIL QUESTIONS <br />Council member Lipton addressed the land dedication and the recommendation to use <br />the 2013 appraisal. He felt it was unusual to base land dedication on a 2013 appraisal <br />instead of the 2014 sale value. Planning and Building Safety Director Russ explained <br />staff's recommendation is for the 2013 appraisal of $224,000. <br />
