She <br />asked for verification of proper public notice. <br />McCartney verified both applications to be heard this evening are complete, and were <br />both mailed to surrounding property owners on September 29, 2014, . published in the <br />Boulder Daily Camera on September 28, 2014; an the property was posted on posted <br />on September 29, 2014. <br />Stuart moved and Meseck seconded a moti• all requirements have been satisfied <br />and the applications submitted by the applic have be roperly filed. Motion <br />passed by unanimous voice vote. <br />Ewy asked if anyone at the hearin • d any objet o the hearing procedures she <br />had described and asked if there other pre ry matters that needed to be <br />taken care of. None were heard. <br />Ewy asked for disclosures from the bo any a visits, ex parte <br />communications, and any conflicts of in -q closures on both <br />applications <br />All Board members indicated they did not have any ex parte communications or any <br />conflicts of interest for both applications. <br />Ewy stated that for the requested variance to be approved, four (4) of the four (4) votes <br />would need to be affirmative. <br />Ewy asked the applicants if they were ready to proceed with the hearing. <br />The applicants indicated they were ready to proceed with the hearing. <br />Staff Presentation of Facts and Issues: <br />McCartney summarized the request for a flood plain development permit for 224 Front <br />Street and 225 Co ad: <br />Backgroun <br />a. roperty located in Old Town Overlay District <br />b. Requires a 3 foot rear yard setback <br />c. Rear yard setback variance required because the existing garages <br />are located within an existing unimproved alley and the applicant is <br />wishing to vacate the alley. <br />d. Once the alley is vacated, a property line adjustment is required. A <br />variance is needed for the property line adjustment. <br />
