The garage structures will not be modified due to the variance, so <br />no changes will occur to alter the character of the neighborhood. <br />f. Vacating the alley would clean up the last remnant piece of <br />unimproved alley right of way. <br />• Staff believes all applicable criteria have been met. <br />• Staff recommends approval of this request. <br />Questions from Board to Staff:: <br />Ewy asked if the garages were demo'd would they have to come back in for another <br />variance. <br />McCartney stated the variance carries with the land so they would not need another <br />variance. <br />Ewy asked if the fire department approved of the garage locations. <br />McCartney stated there was no evidence of how the garages were built, such as <br />building permits, so the fire department did not review this request since there aren't <br />any proposed changes. However, if a new garage is built the garages would need to <br />comply with a 5 foot separation between structures or be constructed with fire rated <br />materials. <br />Applicant Presentation and questions from the Board to the applicant: <br />Lawrence Verbeck, owner of 225 County Road and representative of 224 Front Street, <br />stated he appreciated staff's report and does not have any further presentation. He <br />asked if the board had any questions for him. <br />No questions were asked of the applicant <br />Public Present in Opposition of Application: <br />None heard. <br />Public Present in Favor of Application: <br />Eric Williams, owner of 917 Parkview Street, spoke in favor of the request stating there <br />won't be any physical change to the area so he sees no reason for not approving the <br />variance. <br />Public Hearing Closed / Board Discussion: <br />Stuart stated he agrees with staff's findings and believes the variance is needed to allow <br />for the garages to remain in place. <br />The remainder of the board agreed with his assumptions. <br />Ewy stated she was only concerned about future fire protection, but it sounds like the <br />building permit process will involve fire review. <br />Meseck made a motion to approve.
