Louisville City Council Meeting
January 21, 2003
Page 5

Brown asked Boyd to review the proposed timetable.

Boyd stated the original timetable was very aggressive, with an implementation date of
April 1 st. She reviewed a revised calendar, which pushes the date back to June 1 st. Boyd
stated the discussion and presentation of evaluations and comments of reviewers has been
scheduled for the February 11, 2003, study session. Council can then decide on how they
wish to proceed. She noted the Web Page would be updated tomorrow with more
information on the single trash hauler proposal.

Davidson requested the Staff send a one-page information sheet to residents that would
explain the process.

Brown stated the issue has been discussed at work sessions and stressed no decisions
have been made. He explained heavy trucks, primarily trash collection trucks, cause the
breakdown of City streets. He emphasized the Council will make a decision based on the
significant issues and he encouraged residents to raise their concerns to the Council.

ORDINANCE NO. 1408, SERIES 2002 - AN ORDINANCE APPROVING A
BOUNDARY LINE ADJUSTMENT AGREEMENT AND, IN CONNECTION
THEREWITH, THE EXECUTION OF A QUIT CLAIM DEED AND VACATION
OF A PORTION OF AN ALLEY RIGHT-OF-WAY WITHIN THE JEFFERSON
PLACE SUBDIVISION IN THE CITY OF LOUISVILLE - 2sD READING -
PUBLIC HEARING (advertised Daily Camera 12/28/02)

Davidson called for City Attorney introduction.

City Attorney Sam Light read Ordinance No. 1408, Series 2002.

Davidson called for Staff presentation.

Planning Director Paul Wood reviewed Ordinance No. 1408, Series 2002, which
proposes to resolve the property ownership of a property at 941 Jefferson Avenue. He
explained this parcel has a remnant parcel attached with a metes and bounds description
of additional property. The primary intent of the ordinance is to clarify boundary lines
between public street/alley right-of-ways and private property. He noted Staff's concern
centered on impacts on the public right-of-way for South Street. Resolving ownership of
the remnant parcel and to allow approval of building permits based on established
property lines are the intent of the ordinance. The ordinance vacates any potential interest
the City may have in additional property to achieve a 20-foot alley; authorizes the Mayor
to execute a quit claim deed for the above described property exchange; and authorizes
the Mayor to execute a boundary line agreement that would be recorded to track these
understandings and the resulting new property lines and legal descriptions.

Davidson opened the public hearing and asked if anyone in the audience wished to speak
for or against Ordinance No. 1408, Series 2002.
