now and then. <br />Hor.nbostel stated she would withdraw her <br />motion and moved that this be brought up on <br />the May 1st meeting and put on the agenda. <br />CITY ATTORNEY REPORT <br />Williams stated that the Golf Course Liquor <br />License has been received by the city. The <br />ordinance has been passed so that it is in <br />place when the application was submitted. I <br />was given information from the attorney for <br />the management group and they thought they <br />had until the 25th of April to file all of <br />their documents with the city. State law <br />requires that once the application is <br />received the hearing can not be held within <br />30 days. So we do have to go a least 30 days <br />before we hold our public hearing on the <br />their application process. The 17th of May <br />would be the first day that they would be <br />able to hold a hearing. The grand opening is <br />May 25th. What I would ask you to do tonight <br />is set the public hearing for the Golf <br />Course. We also need to define the <br />neighborhood. (Please see attached maps. If <br />council is welling, council may call a <br />special meeting which would be a public <br />meeting. Once we issue the license they will <br />walk it through the state. <br />Sackett moved tYrat we adopt the geography <br />neighborhood defined by the attorney and hold <br />a special meeting May 17th at 7:00, seconded <br />by Carnival. Motion passed. <br />Williams stated in regard to the ditch across <br />the Mayhoffer property, we have not been able <br />to resolve that by negotiations, so we will <br />initiate condensation processing against <br />this property. <br />Williams also stated information from Public <br />Works has indicated we are having problem <br />with STC. The waste water discharge is <br />violating some the standards, it is not a <br />health concern but there has been some <br />violation standards. If we do not something <br />EPA will initiate charges against us. Our <br />ordinance does allow for us to initiate <br />action in the municipal court and we will be <br />initiating summons against STC for that <br />violation, so we can get this resolved. <br />16 <br />
